Though it is confirmed that the<br \/>\n\tapplicants are the driver and the cleaner.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate Mr.Mirza for the applicant and learned APP<br \/>\n\tMs.Shah for the State and having considered the nature of offence<br \/>\n\tand role attributed to the present applicant, present application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicants are ordered to be<br \/>\n\treleased on regular bail in connection with III-C.R.No.827 of 2010<br \/>\n\tregistered with Vaapi Twon Police Station on their executing bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand) each with one solvent surety each<br \/>\n\tof the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that they shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\ntheir presence before concerned Police Station on 1st<br \/>\nMonday of English calender month between 11:00 AM to 2:00 PM till the<br \/>\ntrial commences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange their residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
