Justice P.N.RAVINDRAN\n\n Dated :23\/05\/2008\n\n O R D E R\n                   J.B.KOSHY &amp; P.N.RAVINDRAN, JJ.\n                        --------------------------------------\n                          W.A.No.366 OF 2008\n                        -------------------------------------\n                          Dated 23rd May, 2008\n\n                                 JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>            Appellant\/petitioner belongs to Christian Nadar community.<\/p>\n<p>She applied for appointment to the post of Staff Nurse Grade II in the<\/p>\n<p>Health Department in Palakkad District. She was included in the short<\/p>\n<p>list published by the Public Service Commission in the supplementary list<\/p>\n<p>of OBC candidates. She claimed reservation under SIUC, but, later it<\/p>\n<p>turned out that she was Nadar Christian, but, that was not specifically<\/p>\n<p>stated. The community certificate Ext.P4 shows that she belongs to<\/p>\n<p>Christian Nadar SIUC. In Ext.P2 application it is specifically stated as<\/p>\n<p>Christian SIUC (OBC) in view of Ext.R3(a) notification.                As per the<\/p>\n<p>Government norms, Nadars (Hindu) and SIUC other than Nadars are<\/p>\n<p>separate categories and in Ext.R3(a) notification                   a mistake was<\/p>\n<p>committed by the Public Service Commission as only Nadars (Hindu)<\/p>\n<p>(item 43) and SIUC (item 57) were shown and Christians Nadar was not<\/p>\n<p>separately shown.     In subsequent notification Nadar (Hindu) and<\/p>\n<p>Christians   are stated separately by Annexure AII.                 Because of the<\/p>\n<p>omission in notification regarding the scheduled enlistment of OBC<\/p>\n<p>communities, petitioner cannot suffer.                    Petitioner has correctly<\/p>\n<p><span class=\"hidden_text\">W.A.366\/2008                      2<\/span><\/p>\n<p>shown the caste and certificate was produced and she is eligible for<\/p>\n<p>reservation under OBC community.
