No. 1984 of 2010 and I.A. No. 1985 of<\/p>\n<p>                  2010 have been filed on behalf of Intervenors Nand<\/p>\n<p>                  Kishore Prasad and Niripendra Kumar Mandal for<\/p>\n<p>                  being impleaded as petitioners in this writ application<\/p>\n<p>                  and for allowing similar relief to them also as prayed<\/p>\n<p>                  by the petitioner Sunil Kumar.\n<\/p>\n<p>                          Considering    the     fact    that        intervention<\/p>\n<p>                  application has been filed after five years of the filing<\/p>\n<p>                  of the writ application the prayer of interveners for<\/p>\n<p>                  being impleaded as petitioners cannot be allowed. It is<\/p>\n<p>                  dismissed.   They   have     liberty   to   file    their   writ<\/p>\n<p>                  applications independently.\n<\/p>\n<p>                          Initially the prayer of the writ petitioner was<\/p>\n<p>                  for quashing of memo no.321 dated 1.10.2001,<\/p>\n<p>                  whereby he was terminated from his service. Further<\/p>\n<p>                  prayer of the petitioner was for a direction to make<\/p>\n<p>                  payment of all consequential benefits and due salary.<\/p>\n<p>                  Petitioner has alleged in the writ application that the<\/p>\n<p>                  impugned order contained in Annexure-1 was issued<\/p>\n<p>                  for terminating his service without following the rule<\/p>\n<p>                  of natural justice. During the pendency of the writ<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>application the petitioner along with other 30 persons<\/p>\n<p>was reinstated in the Adult Education Department in<\/p>\n<p>the light of order passed in CWJC No. 15365 of 2001<\/p>\n<p>and analogous cases. The termination order which is<\/p>\n<p>under     challenge         in    this    writ      application     similar<\/p>\n<p>termination order has been issued against the writ<\/p>\n<p>petitioners in CWJC No. 15365                       of 2001      and CWJC<\/p>\n<p>No. 11771 of 2003, on account of quashing of those<\/p>\n<p>orders,    petitioner            was      also      given     benefit    of<\/p>\n<p>reinstatement.         However            the       grievance      of   the<\/p>\n<p>petitioner which still needs adjudication relates to<\/p>\n<p>non-payment of arrears of salary for the period in<\/p>\n<p>between         his        termination           and      reinstatement.<\/p>\n<p>Petitioner&#8217;s case is that he was given similar relief as<\/p>\n<p>it was allowed in case of the writ petitioners in those<\/p>\n<p>cases but discriminated in the matters of payment of<\/p>\n<p>arrears of salary. Krishnandan Prasad, Radha Shyam<\/p>\n<p>Sharma and Binod Kumar Verma and others were<\/p>\n<p>reinstated and also were paid entire dues of their<\/p>\n<p>arrears    of     salary         for     the     period     in    between<\/p>\n<p>retrenchment          and        the     reinstatement           and    the<\/p>\n<p>petitioner for such reliefs has filed I.A. No. 6290 of<\/p>\n<p>2008 with a prayer for amending the relief. The<\/p>\n<p>amended         prayer       was       for      a    direction     to   the<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>respondents to pay salary and other allowances to the<\/p>\n<p>petitioner for the period in between 1.10.2001 to<\/p>\n<p>11.1.2006 as it has been done in the case of Radha<\/p>\n<p>Krishna Sharma and Sri Binod Kumar Verma and<\/p>\n<p>other whose cases are identical to the petitioner. In<\/p>\n<p>support of his claim petitioner has annexed order<\/p>\n<p>passed in case of Binod Kumar Verma and counter<\/p>\n<p>affidavit filed in case of Radha Krishna Sharma as<\/p>\n<p>Annexure-2 series. These two documents indicate that<\/p>\n<p>Binod Kumar Verma and Radha Krishna Sharma were<\/p>\n<p>paid entire dues of their arrears of salary, dearness<\/p>\n<p>allowance, rent allowance and conveyance allowed for<\/p>\n<p>the   period   in   between   their   retrenchment   and<\/p>\n<p>reinstatement.\n<\/p>\n<p>        Time was allowed to the counsel appearing for<\/p>\n<p>the State, in order to seek instruction    on the point<\/p>\n<p>that what is the reason for discriminating in case of<\/p>\n<p>this petitioner. No supplementary counter affidavit<\/p>\n<p>could be filed by the State as the counsel has not yet<\/p>\n<p>received any instruction from the Department.<\/p>\n<p>        In the facts and circumstances of the case,<\/p>\n<p>the Interlocutory application is allowed. Relief prayed<\/p>\n<p>in the I.A. application is treated to be a part of the<\/p>\n<p>writ application. The amended relief prayed by the<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>           petitioner is allowed. The respondents are directed to<\/p>\n<p>           make payment of entire dues of arrears of salary to<\/p>\n<p>           the petitioner for the period in between 1.10.2001 to<\/p>\n<p>           11.1.2006   with       all   consequential     benefits   and<\/p>\n<p>           allowances. All    payment must be            made to the<\/p>\n<p>           petitioner within a period of eight weeks from the date<\/p>\n<p>           of production\/ communication of this order.<\/p>\n<p>                   The writ application stands allowed.<\/p>\n<p>                                        ( Mridula Mishra, J.)<br \/>\nA.
