Heard learned counsel for the parties.<\/p>\n<p>                      The petitioner seeks quashing of the order<\/p>\n<p>           contained in memo no.1206 dated 9.11.2005 placed at<\/p>\n<p>           Annexure-1 to the writ petition as also the order<\/p>\n<p>           bearing    memo   ono.1134   dated   27.10.2005   placed   at<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Annexure-2 to the writ petition, whereby his claim<\/p>\n<p>for payment of family pension has been rejected.<\/p>\n<p>               Learned counsel for the petitioner, with<\/p>\n<p>reference        to      the     statements       made        in    the    writ<\/p>\n<p>petition as also in the other affidavits filed in<\/p>\n<p>the proceedings, submits that the petitioner was the<\/p>\n<p>first wife of the deceased employee late Ram Krishna<\/p>\n<p>Ram who retired as an Assistant Electrical Engineer<\/p>\n<p>on 31.10.1999 and expired on 11.7.2004. As Late Ram<\/p>\n<p>Krishna        Ram    expired       on   11.7.2004,      the       respondent<\/p>\n<p>no.6 being his wife and duly named in the pension<\/p>\n<p>payment        order       to       receive     the     family       pension,<\/p>\n<p>submitted her application for the said payment which<\/p>\n<p>also   has      been      enclosed       with    Annexure-1.         Pursuant<\/p>\n<p>thereto, the family pension was being paid to her<\/p>\n<p>and she continued to draw the same.                                Until such<\/p>\n<p>time, no dispute came to be raised and it is only<\/p>\n<p>thereafter that the petitioner chose to question the<\/p>\n<p>authority        of      the    respondent       no.6    to    receive      the<\/p>\n<p>family pension claiming to be the legally wedded<\/p>\n<p>wife      of     the       deceased        employee       and       in     this<\/p>\n<p>connection,          a   legal       notice     was   forwarded       on    her<\/p>\n<p>behalf to the respondent authorities of the Board<\/p>\n<p>questioning the action of the Board in according the<\/p>\n<p>family pension to the respondent no.6. The legal<\/p>\n<p>notice and the prayer made thereunder was disposed<\/p>\n<p>of   by   the        respondents         upon   consideration         of    the<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>family    genealogy,             pension         form     and       application<\/p>\n<p>submitted by the respondent no.6 for family pension<\/p>\n<p>and   whereupon        it     was         decided      that    the       grant      of<\/p>\n<p>family    pension           to       the    respondent         no.6       was       in<\/p>\n<p>accordance with the Rules.\n<\/p>\n<p>           A    communication               to    the    said       effect          was<\/p>\n<p>issued    to    the        petitioner&#8217;s          counsel       on    27.10.2005<\/p>\n<p>(Annexure-2).              The petitioner was also separately<\/p>\n<p>communicated          of    the       decision         vide     letter         dated<\/p>\n<p>9.11.2005 (Annexure-1). Aggrieved by the said order,<\/p>\n<p>the petitioner has filed the writ petition assailing<\/p>\n<p>the order(s) as contained in Annexure-1 and 2.<\/p>\n<pre>           Learned            counsel            for     the         petitioner\n\nassailing       the    order          as    contained         in    Annexure-1,\n\n<\/pre>\n<p>submitted that the orders have been passed without<\/p>\n<p>making    due    enquiry             by    the   authorities.            He,    with<\/p>\n<p>reference to the family genealogy enclosed with the<\/p>\n<p>pension payment order, submitted that the daughters<\/p>\n<p>named in the said genealogy whose names appear at<\/p>\n<p>serial no.3 to 6, are the daughters born from the<\/p>\n<p>wedlock    between          the       petitioner        and        the   deceased<\/p>\n<p>employee. It is submitted that the fact that the<\/p>\n<p>date of birth of the eldest daughter is 14.1.1964 is<\/p>\n<p>by itself sufficient to prove that the marriage of<\/p>\n<p>this petitioner took place prior to 1964. Proceeding<\/p>\n<p>on this argument, learned counsel, relied upon a<\/p>\n<p>statement       made        by        the    respondent            no.6        in     a<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>proceeding before the Tehsildar and submitted that<\/p>\n<p>the respondent no.6 herself has stated that she was<\/p>\n<p>married to the deceased employee in the year 1970.<\/p>\n<p>Learned counsel further with reference to the photo<\/p>\n<p>identity card issued by the Election Commission of<\/p>\n<p>India      enclosed    with      Annexure-4,      submits     that      the<\/p>\n<p>said identity card itself certifies the petitioner<\/p>\n<p>to    be    the    legally       wedded    wife   of    the   deceased<\/p>\n<p>employee. Upon being questioned as to the supporting<\/p>\n<p>documents         in   possession         of   the     petitioner       in<\/p>\n<p>relation to her marriage with the deceased employee,<\/p>\n<p>learned counsel for the petitioner could not produce<\/p>\n<p>any such document except the family genealogy.<\/p>\n<p>             The names mentioned in the family genealogy<\/p>\n<p>includes the deceased employee and the respondent<\/p>\n<p>no.6. The names present at serial no.3 to 6 are<\/p>\n<p>admittedly those of the daughters of the deceased<\/p>\n<p>employee. The petitioner claims that they were born<\/p>\n<p>from the wedlock between herself and the deceased<\/p>\n<p>employee. Whether or not they in fact were born from<\/p>\n<p>the wedlock between the petitioner and the deceased<\/p>\n<p>employee, is a rebuttable presumption.<\/p>\n<p>             Admittedly,         the      petitioner     is       not   in<\/p>\n<p>possession        of   any   such      document      except   a    family<\/p>\n<p>genealogy and the photo identity card to support her<\/p>\n<p>marriage with the deceased employee. In absence of<\/p>\n<p>any   substantive       piece      of     evidence     supporting       the<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>submission of the petitioner, this Court would not<\/p>\n<p>delve into the issue. Even the statement made by<\/p>\n<p>respondent no.6 in a proceeding pending before a<\/p>\n<p>Tehsildar can not come to the aid of the petitioner.<\/p>\n<p>The respondent no.6 has nothing further to do in<\/p>\n<p>view    of   the    certification            given    by     the    deceased<\/p>\n<p>employee himself in her favour, of being his legally<\/p>\n<p>wedded wife. The petitioner has not been able to<\/p>\n<p>controvert     the      said       position,        either    by    help    of<\/p>\n<p>direct   or    indirect           evidence     which    are    manifestly<\/p>\n<p>absent in the present proceedings.\n<\/p>\n<p>              In the circumstances, I find no infirmity<\/p>\n<p>with the order passed by the respondent Board placed<\/p>\n<p>at   Annexures-1        and       2   and    accordingly,      this       writ<\/p>\n<p>petition is dismissed with no order as to costs.<\/p>\n<pre>             The    dismissal           of     the     writ        petition,\n\nhowever,      would     not       preclude     the     petitioner         from\n\n<\/pre>\n<p>raising her grievance and seeking a declaration from<\/p>\n<p>a court of competent civil jurisdiction as regarding<\/p>\n<p>her marital status with the deceased employee and<\/p>\n<p>which    may       be   considered            and     disposed       of    in<\/p>\n<p>accordance with law own its own merits.<\/p>\n<p>                                       (Jyoti Saran,J.)<\/p>\n<p>Patna High court,<br \/>\nDated, 29th April,2010<br \/>\nNAFR\/ ahk\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court Sharda vs The Bihr State Electricity Boa on 29 April, 2010 Author: Jyoti Saran CIVIL WRIT JURISDICTION CASE No.15329 OF 2005 In the matter of an application under Article 226 of the Constitution of India.
