SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner has prayed for the following reliefs;\n<\/p>\n<p>(b)\tYour<br \/>\nLordships be pleased to issue writ of mandamus or any other<br \/>\nappropriate writ, direction or order holding that the order passed by<br \/>\nthe respondents dated 24\/01\/1997 in Vivad Case No. 13\/1993-1997 and<br \/>\nconfirmed by order dated 15\/31-12-2003 in JMN\/SNR\/35\/1997 is<br \/>\nunconstitutional, bad in law and same be quashed and set aside.\n<\/p>\n<p>(c)\tYour<br \/>\nLordships be further pleased to issue writ of mandamus or any other<br \/>\nwrit, direction or order directing the respondents to consider the<br \/>\ncase of the petitioner for continuation of grant and\/or re-grant of<br \/>\nthe land in question on suitable terms and conditions.\n<\/p>\n<p>2.\tShri<br \/>\nKirtidev Dave, learned advocate appearing on behalf of the petitioner<br \/>\ndoes not press the present petition with respect to the prayer in<br \/>\nterms of paragraph 12(b), however has submitted that the petitioner<br \/>\nproposes to submit an appropriate application for re-grant of the<br \/>\nland in question, which can be directed to be considered in<br \/>\naccordance with law on its own merits.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, the present Special Civil Application is dismissed<br \/>\nas withdrawn so far as the prayer in terms of paragraph 12(b) is<br \/>\nconcerned.  So far as the prayer of the petitioner to re-grant the<br \/>\nland in question is concerned, as and when an application is<br \/>\nsubmitted by the petitioner for re-grant of the land in question the<br \/>\nsame may be considered in accordance with law and as per the policy<br \/>\nof the State Government, if permissible now, for which this Court has<br \/>\nnot expressed anything on merits and it is ultimately for the<br \/>\nappropriate authority to decide the same in accordance with law on<br \/>\nits own merits and as per the policy of the State Government,  if<br \/>\npermissible now.\n<\/p>\n<p>4.\tWith<br \/>\nthis, the present petition is dismissed.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bharwad vs State on 5 April, 2011 Author: M.R.
