SHAH\n\t\t\n\t\n\n \n\nDate\n: 19\/03\/2009 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner   original defendant has prayed for an appropriate<br \/>\nWrit, direction and\/or order quashing and setting aside the impugned<br \/>\norder dated 12.04.2004 passed by the learned City Civil Judge,<br \/>\nAhmedabad below leave to defend application in Summary Suit No.8312<br \/>\nof 2003 by which the learned Judge has granted conditional leave to<br \/>\ndefend the petitioner   original defendant to defend aforesaid suit<br \/>\non condition to deposit Rs.25,000\/-.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe outset it is required to be noted that while admitting the<br \/>\npresent Special Civil Application, the learned Single Judge has<br \/>\ngranted ad-interim relief in terms of para 6(b) on condition<br \/>\nthat the petitioner shall deposit 40% of the suit claim within a<br \/>\nperiod of four weeks from 11.03.2005 and the petitioner must have<br \/>\ndeposited the said amount as it was conditional interim order granted<br \/>\nby the learned Single Judge. Be that as it may. Considering the<br \/>\nimpugned order passed by the learned Judge granting conditional leave<br \/>\nto petitioner to defend aforesaid suit on condition to deposit<br \/>\nRs.25,000\/- cannot be said to erroneous and\/or illegal and\/or<br \/>\ncontrary to the provisions.  Prima-facie it appears that as<br \/>\nsuch there are no triable issues and the learned Judge has dealt with<br \/>\nthe same in the impugned order.  Against the claim of Rs.52,818\/- for<br \/>\nthe goods supplied, the learned Judge has granted conditional leave<br \/>\nto the petitioner on deposit of Rs.25,000\/- only.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of above when there are no triable issues, still the learned<br \/>\nJudge has directed the petitioner to deposit only Rs.25,000\/-. Under<br \/>\nthe circumstances and in the facts and circumstances of the case, it<br \/>\ncannot be said that the impugned order passed by the learned Judge<br \/>\ndeserves interference of this Court in exercise of powers under<br \/>\nArticle 227 of the Constitution of India.\n<\/p>\n<p>4.\t\tFor<br \/>\nthe reasons stated above, the petition fails and deserves to be<br \/>\ndismissed and accordingly it is dismissed.
