Justice ANTONY DOMINIC\n\n Dated :19\/02\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                         ===============\n\n           W.P.(C) NOS. 5829, 5853 &amp; 5863 OF 2008\n\n          ============================\n\n\n           Dated this the 19th day of February, 2008\n\n\n                               J U D G M E N T\n<\/pre>\n<p>      In   all   these   cases,   the   complaint   of   the   writ   petitioners   is<\/p>\n<p>that the Motor Vehicles Tax in respect of the vehicles owned by<\/p>\n<p>them is not accepted by the Taxation Officer for the reason that<\/p>\n<p>the   petitioners   have   not   produced   certificate   as   required   under<\/p>\n<p>Section 8(A) of the Motor Transport Workers Welfare Fund Act of<\/p>\n<p>having discharged their dues under the Motor Transport Workers<\/p>\n<p>Welfare   Fund   Scheme.     Based   on   the   Government   clarification<\/p>\n<p>that   Educational   institutions   are   not   Motor   Transport<\/p>\n<p>Undertakings,   this   court   has   already   rendered   judgment   in   the<\/p>\n<p>case   of  Toc&#8217;H   Public   School   v.   District   Executive   Officer<\/p>\n<p>(1992(1) KLT S.N.Case NO.49)  that it is not the requirement<\/p>\n<p>of educational institutions to make payment of the welfare fund<\/p>\n<p>dues.   Following   the   aforesaid   judgment,   this   court   also   has<\/p>\n<p>disposed of a batch of writ petitions including WP(C) No.1208\/08.<\/p>\n<p>WPC 5829, 5853,5863\/08<\/p>\n<p><span class=\"hidden_text\">                                     :2 :<\/span><\/p>\n<p>Adopting the same reasoning as adopted in the aforesaid cases, I<\/p>\n<p>dispose   of   these   writ   petitions   also   directing   that   the   Motor<\/p>\n<p>Vehicles Tax tendered by the petitioners herein will be accepted<\/p>\n<p>by the Taxation Officer without insisting on certificate as specified<\/p>\n<p>under Section 8(A) of the Motor Transport Workers Welfare Fund<\/p>\n<p>Act.\n<\/p>\n<\/p>\n<p>        Writ petitions are disposed of as above.\n<\/p>\n<\/p>\n<p>                                             ANTONY DOMINIC,JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court The Pappinisseri Hidayathul &#8230; vs State Of Kerala Represented By Its on 19 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 5829 of 2008(R) 1.
