SIRI JAGAN, J.\n                ------------------------------------\n                  W.P.(C)No.37497 OF 2007\n              ----------------------------------------\n                Dated this the 7th day of March, 2008\n\n                           JUDGMENT\n<\/pre>\n<p>      The petitioner is challenging disciplinary proceedings<\/p>\n<p>initiated against him.    He raises inter-alia a ground that the<\/p>\n<p>Government has not independently considered the explanation<\/p>\n<p>submitted by the petitioner before deciding to proceed further in<\/p>\n<p>accordance with the Kerala Civil Services (Classification Control<\/p>\n<p>and Appeal) Rules, 1960.\n<\/p>\n<p>      2.   The Government pleader would contend that it is after<\/p>\n<p>the Government considered the matter appropriately that the<\/p>\n<p>decision to continue disciplinary proceedings against the<\/p>\n<p>petitioner as per Ext.P5 was taken.\n<\/p>\n<p>      3.   I have heard both sides.           In Ext.P5 order the<\/p>\n<p>Government has stated thus:\n<\/p>\n<blockquote><p>              &#8220;Memo of charges and statement of allegations<br \/>\n        were served on Shri. Gopakumaran Nair vide<br \/>\n        reference   read  as   2nd   paper   above.   Shri.\n<\/p><\/blockquote>\n<blockquote><p>        Gopakumaran     Nair   submitted     the    Written<br \/>\n        Statement of Defence and the Director of Medical<br \/>\n        Education vide letter above reported that Written<br \/>\n        Statement of Defence is not satisfactory.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(c) No.37497\/07               2<\/span><\/p>\n<p>Ext.P5 indicates that the Government had gone by the report<\/p>\n<p>of the Director of Medical Education as to whether the written<\/p>\n<p>statement of defence is satisfactory or not. There is nothing in<\/p>\n<p>Ext.P5,     which   indicates   that    the    Government     had<\/p>\n<p>independently considered the written statement of defence<\/p>\n<p>filed by the petitioner before deciding to proceed further as<\/p>\n<p>directed in Ext.P5.    The Government being the disciplinary<\/p>\n<p>authority, the Government ought to have independently<\/p>\n<p>considered the written statement of defence before taking a<\/p>\n<p>decision as to whether the same is satisfactory or not.<\/p>\n<p>      In the above circumstances, Ext.P5 is quashed and this<\/p>\n<p>writ petition is disposed of with the following directions:<\/p>\n<p>      The 1st respondent shall independently consider Ext.P3<\/p>\n<p>written statement of defence submitted by the petitioner and<\/p>\n<p>shall take an independent decision as to whether the same is<\/p>\n<p>satisfactory or not, in order to either continue the disciplinary<\/p>\n<p>proceedings as per the Kerala       Civil Services (Classification<\/p>\n<p>Control and Appeal) Rules, 1960, or to drop further<\/p>\n<p>proceedings. Needless to say, further proceedings pursuant to<\/p>\n<p>Ext.P5, already taken, would also stand quashed.<\/p>\n<p>                                          S.
