Justice S.SIRI JAGAN\n\n Dated :07\/08\/2008\n\n O R D E R\n                      S.SIRI JAGAN, J\n                ==================\n                 W.P(C)No.22722 of 2008\n                ==================\n         Dated this the 7th day of August, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>     This writ petition filed on 13.10.2006 is coming up for<\/p>\n<p>admission today. The issue involved in this writ petition is<\/p>\n<p>as to whether the confiscation of rice seized from the<\/p>\n<p>petitioner under the Food Grains Dealer&#8217;s Licensing Order<\/p>\n<p>is sustainable. The petitioner applied for a licence under<\/p>\n<p>the Food Grains Dealer&#8217;s Licensing Order. According to the<\/p>\n<p>petitioner, anticipating favourable orders in the application<\/p>\n<p>for licence, the petitioner started business and procured<\/p>\n<p>rice.   The authorities seized the same.          While the<\/p>\n<p>confiscation proceedings were pending, the rice was<\/p>\n<p>released to the petitioner on his furnishing bank guarantee<\/p>\n<p>for an amount of Rs.1,32,000\/-, determined as the value of<\/p>\n<p>the same. Subsequently the confiscation proceedings were<\/p>\n<p>finalised directing confiscation of the rice. Consequently,<\/p>\n<p>the bank guarantee was invoked. The said proceedings are<\/p>\n<p><span class=\"hidden_text\">W.P(C)No.22722 of 2008       &#8211; 2 &#8211;<\/span><\/p>\n<p>under challenge in this writ petition.\n<\/p>\n<p>     2. I have heard the learned Government Pleader also.<\/p>\n<p>     Admittedly, at the time when the rice was seized from<\/p>\n<p>the petitioner, the petitioner did not have a licence under<\/p>\n<p>the Food Grains Dealer&#8217;s Licensing Order. Therefore, the<\/p>\n<p>petitioner cannot now dispute that the action of the<\/p>\n<p>respondents was illegal. The fact that the petitioner was<\/p>\n<p>anticipating a favourble order in an application for licence<\/p>\n<p>is not a valid defence against an action for doing business in<\/p>\n<p>rice without a valid licence. That being so, I do no find<\/p>\n<p>anything wrong with the orders directing confiscation of the<\/p>\n<p>rice.
