M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr B S Brahmbhatt, learned counsel for the applicant  and<br \/>\nMr N J Shah, learned AGP for the respondent.  Mr Brahmbhatt, learned<br \/>\ncounsel has urged that neither upgradation of post of Driver nor<br \/>\nhigher pay scale for the post of Driver has been granted by the<br \/>\nrespondent and the court has committed mistake in observing that the<br \/>\nupgradation and the higher pay scale admissible to the petitioners<br \/>\nhas been granted by relying upon the statement made by the learned<br \/>\nAGP.\n<\/p>\n<p>\t\tRule.\n<\/p>\n<p>Mr N J Shah, learned AGP waives service of Rule on behalf of the<br \/>\nrespondent in the delay condonation application as well as on the<br \/>\nReview Petition.  In the facts and circumstances,<br \/>\nthe delay condonation application is allowed.  The delay in filing<br \/>\nthe Misc. Civil Application for review is condoned.  Rule is made<br \/>\nabsolute.\n<\/p>\n<p> Misc.Civil<br \/>\nApplication No.2577 of 2011<\/p>\n<p>\t\tIn<br \/>\nview of the arguments of the learned counsel for the parties, this<br \/>\nReview Application is allowed.  The order dated 27.4.2011 passed by<br \/>\nthis Court is recalled.
