\tBy
\nway of this petition the petitioner has chllenged the order dated
\n29th July 2010 of the Gujarat Revenue Tribunal passed in
\nRevision Application No.TEN\/BA\/40 of 2009.  Though the petition is
\nstyled as a petition filed under Article 226 of the Constitution of
\nIndia, it should be under Article 227 of the Constitution of India.
\nArticles 226 and 227 of the Constitution of India are reproduced
\nhereinbelow:-\n<\/p>\n
  226.
\n\tPower of High Courts to issue certain writs.- (1) Notwithstanding
\nanything in Article 32 every High Court shall have power, throughout
\nthe territories in relation to which it exercises jurisdiction, to
\nissue to any person or authority, including in appropriate cases, any
\nGovernment, within those territories directions, orders or writs,
\nincluding writs in the nature of habeas corpus, mandamus,
\nprohibition, quo warranto and certiorari, or any of them, for the
\nenforcement of any of the rights conferred by Part III and for any
\nother purpose.\n<\/p>\n
(2)\tThe
\npower conferred by clause (1) to issue directions, orders or writs to
\nany Government, authority or person may also be exercised by any High
\nCourt exercising jurisdiction in relation to the territories within
\nwhich the cause of action, wholly or in part, arises for the exercise
\nof such power, notwithstanding that the seat of such Government or
\nauthority or the residence of such person is not within those
\nterritories.\n<\/p>\n
(3)<\/span><\/p>\n
\tWhere any party against whom an interim order, whether by way of
\ninjunction or stay or in any other manner, is made on, or in any
\nproceedings relating to, a petition under clause (1), without –\n<\/p>\n
(a)
\n\tfurnishing to such party copies of such petition and all documents
\nin support of the plea for such interim order, and<\/p>\n
(b)
\n\tgiving such party an opportunity of being heard, makes an
\napplication to the High Court for the vacation of such order and
\nfurnishes a copy of such application to the party in whose favour
\nsuch order has been made or the counsel of such party, the High Court
\nshall dispose of the application within a period of two weeks from
\nthe date on which it is received or from the date on which  the copy
\nof such application is so furnished, whichever is later, or where the
\nHigh Court is closed on the last day of that period, before the
\nexpiry of the next day afterwards on which the High Court is open;
\nand if the application is not so disposed of, the interim order
\nshall, on the expiry of that period, or, as the case may be, the
\nexpiry of the said next day, stand vacated.\n<\/p>\n
\t(4)\tThe
\npower conferred on a High Court by this article shall not be in
\nderogation of the power conferred on the Supreme Court by clause (2)
\nof article 32.  Constitutional validity of Central laws not to be
\nconsidered in proceedings under article 226.\n<\/p>\n
227. Power of superintendence over all courts by the High  \tCourt. –\n<\/p>\n
(1)<\/span><\/p>\n
\tEvery High Court shall have superintendence over all courts and
\ntribunals throughout the territories in relation to which it
\nexercises jurisdiction.\n<\/p>\n
(2)<\/span><\/p>\n
\tWithout prejudice to the generality of the foregoing provision, the
\nHigh Court may –\n<\/p>\n
\t(a)
\ncall for returns from such courts;\n<\/p>\n
(b)
\nmake and issue general rules and prescribe forms for  regulating the
\npractice and proceedings of such courts; and<\/p>\n
(c)
\nprescribe forms in which books, entries and accounts shall be kept by
\nthe officers of any such courts.\n<\/p>\n
(3)<\/span><\/p>\n
\tThe High Court may also settle tables of fees to be allowed to the
\nsheriff and all clerks and officers of such courts and to attorneys,
\nadvocates and pleaders practising therein:\n<\/p>\n
\tProvided
\nthat any rules made, forms prescribed or tables settled under clause
\n(2) or clause (3) shall not be inconsistent with the provision of any
\nlaw for the time being in force, and shall require the previous
\napproval of the Governor.\n<\/p>\n
(4)<\/span><\/p>\n
\tNothing in this article shall be deemed to confer on a High Court
\npowers of superintendence over any court or tribunal constituted by
\nor under any law relating to the Armed Forces.\n<\/p>\n
\tThe
\npetitioner has made the following prayers in paragraph 9 of the
\npetition:-\n<\/p>\n
 (A)\tYOUR
\nLORDSHIPS may be pleased to issue a writ of mandamus or a writ of
\ncertiorari or any other appropriate writ, order or direction,
\nquashing and setting aside the impugned order dated 29.07.2010 passed
\nby the Gujarat Revenue Tribunal in Stay Application in Revision
\nApplication No.TEN\/BA\/40\/2009 as being illegal, unjust, contrary to
\nlaw, unreasonable and contrary to the facts and evidence and
\nviolative of Article 14 and 19 of the Constitution of India, in the
\ninterest of justice;\n<\/p>\n
(B)\tYOUR
\nLORDSHIPS may be pleased to restrain the respondents from
\ntransferring, selling, dealing with and\/or alienating the subject
\nland pending the admission, hearing and final disposal of the
\npetition, in the interest of justice;\n<\/p>\n
(C)\tYOUR
\nLORDSHIPS may be pleased to stay the implementation, operation and
\nexecution of the order dated 29.07.2010 passed by the Gujarat Revenue
\nTribunal in Stay Application in Revision Application
\nNo.TEN\/BA\/40\/2009 and further be pleased to direct the parties to
\nmaintain status quo in respect of the subject land, pending the
\nadmission, hearing and final disposal of the petition, in the
\ninterest of justice;\n<\/p>\n
(D)\txxx\t\t\t\txxx\t\t\txxx \n \n\n \n\n\n \n\n\tConsidering\n<\/pre>\n
the prayers made by the petitioner, the main prayer is challenging
\nthe order of the Tribunal and no other prayer is made which pertains
\nto Articles 14 and 19 or 226 of the Constitution of India.
\nTherefore, substantially this matter is under Article 226 of the
\nConstitution of India.   In my view, the practice which is adopted by
\nthe petitioner is required to be deprecated.\n<\/p>\n
\tThe
\nimpugned order which is subject matter of the challenge is of 29th
\nJuly 2010 whereby the Tribunal, after considering the evidence, has
\ncome to the conclusion that the petitioner is neither in possession
\nof the land nor his name is reflected in the revenue record.\n<\/p>\n
\tThe
\ncounsel for the petitioner has attempted to rely upon the decision of
\nthe Honourable Supreme Court in the case of  Maharwal Khewaji
\nTrust, Faridkot v. Baldev Dass,<\/a>
\nreported in AIR 2005 SC 104.   In my view, the rights which
\nare considered under the revenue proceedings is different than civil
\nproceedings.    Since the petitioner is neither in possession of the
\nland nor his name is reflected in the revenue record, it is not
\nappropriate to disturb the findings of the Gujarat Revenue Tribunal.
\n  Hence, the petition deserves to be dismissed and is dismissed
\naccordingly.\n<\/p>\n
