BIHPUR, DISTRICT- BHAGALPUR.\n                                    Versus\n                           THE STATE OF BIHAR .\n                                   -----------\n<\/pre>\n<p>2.   11.02.2011                Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                                 The petitioner is in custody in relation to Bihpur<\/p>\n<p>                   P.S. Case No. 154 of 2010 instituted under Sections 302,201 and<\/p>\n<p>                   34 of the Indian Penal Code read with Section 27 of the Arms<\/p>\n<p>                   Act.\n<\/p>\n<p>                              In the First Information Report lodged by the brother<\/p>\n<p>                   of the deceased, it is alleged that the petitioner along with others<\/p>\n<p>                   including Niraj Modi had come and taken his younger brother<\/p>\n<p>                   Subodh Singh, but the deceased did not return in the night. Next<\/p>\n<p>                   morning his dead body was recovered which was concealed in a<\/p>\n<p>                   field. Thereafter, on the basis of last seen theory petitioner has<\/p>\n<p>                   been named in the F.I.R. Learned Sessions Judge has also<\/p>\n<p>                   noticed that apart from being last seen with the deceased there is<\/p>\n<p>                   nothing further material in the matter. Learned counsel for the<\/p>\n<p>                   petitioner submits that in Cr. Misc. No. 32060 of 2010, Niraj<\/p>\n<p>                   Modi who was exactly identically as the petitioner, has been<\/p>\n<p>                   granted bail by this Court vide order dated 23.11.2010.<\/p>\n<p>                           Be that as it may, petitioner, namely, Brajesh Jha is<\/p>\n<p>                   directed to be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                   10,000\/-(Ten Thousand) with two sureties of the like amount<\/p>\n<p>                   each to the satisfaction of the learned III, Additional Sessions<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>            Judge, Naugachia at Bhagalpur in S.Tr.
