M. SAHAI)<\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr.N.J.Shah, learned Assistant Government Pleader for the<br \/>\nappellants. This Letters Patent Appeal has been filed challenging the<br \/>\njudgment of the learned Single Judge dated 14th June,2007 passed in<br \/>\nSpecial Civil Application No. 14117 of 2007. The learned Single Judge<br \/>\nin paragraphs 8, 9 and 10 of his judgment has issued the following<br \/>\ndirections:\n<\/p>\n<p>&#8220;8.\n<\/p>\n<p> Therefore, it is directed to the respondent to consider the<br \/>\nrepresentation of the petitioner and examine the grievance of the<br \/>\npetitioner in light of the observations made by the Apex Court as<br \/>\nreferred above and when the father of the petitioner died at that<br \/>\ntime whatever the policy was prevailing, same benefit should have to<br \/>\nextended in favour of the petitioner or not ? by passing appropriate<br \/>\nreasoned order in accordance with the law within a period of three<br \/>\nmonths from the date of receiving the copy of such representation<br \/>\nfrom the petitioner.\n<\/p>\n<p>9.<br \/>\n In view of the above observations and directions, present petition<br \/>\nis disposed of without expressing any opinion on merits.\n<\/p>\n<p>10.<br \/>\n However, in case if ultimate decision is adverse to the petitioner,<br \/>\nit is open for the petitioner to challenge the same before<br \/>\nappropriate forum in accordance with law.&#8221;\n<\/p>\n<p>2.\t\tSince<br \/>\nonly direction has been issued to the respondents to examine<br \/>\ngrievances of the petitioner and for considering the claim<br \/>\nof the petitioner for compassionate appointment, we are not inclined<br \/>\nto interfere with the matter at this stage. We do not find any merit<br \/>\nin this Letters Patent Appeal. This Appeal fails and is accordingly<br \/>\ndismissed.
