BASANT, J.\n                 - - - - - - - - - - - - - - - - - - - - - -\n                    Crl.R.P.No. 9 of 2008\n                 - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 3rd day of January, 2008\n\n                              O R D E R\n<\/pre>\n<p>     This revision     petition is directed against a concurrent<\/p>\n<p>verdict of guilty, conviction and sentence in a prosecution under<\/p>\n<p>Section 138 of the N.I. Act. The petitioner now faces a sentence<\/p>\n<p>of S.I. for a period of one year and to pay the actual cheque<\/p>\n<p>amount of Rs. 2,97,000\/- as compensation and                   in default to<\/p>\n<p>undergo S.I. for a further period of three months.<\/p>\n<p>     2.     The transaction is admitted. The                signature in the<\/p>\n<p>cheque is admitted. Handing over of the cheque is not disputed.<\/p>\n<p>The notice of demand, though duly received and acknowledged,<\/p>\n<p>did not admittedly evoke any response.               No defence evidence<\/p>\n<p>was adduced.\n<\/p>\n<p>     3.         The courts below, in these circumstances,<\/p>\n<p>concurrently came to the conclusion that the complainant has<\/p>\n<p>succeeded    in   establishing all ingredients of              the offence<\/p>\n<p>Crl.R.P.No. 9 of 2008<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>punishable    under Section 138 of the N.I. Act. Accordingly they<\/p>\n<p>proceeded to pass the impugned concurrent judgments.<\/p>\n<p>      4.   Called upon to explain the nature of challenge which the<\/p>\n<p>petitioner wants to mount against the impugned concurrent judgments,<\/p>\n<p>the learned counsel for the petitioner does not strain to assail the<\/p>\n<p>verdict of guilty and conviction on merits.       He only prays that<\/p>\n<p>leniency may be shown on the question of sentence and some time may<\/p>\n<p>be granted to the petitioner to discharge the liability and avoid the<\/p>\n<p>default sentence.\n<\/p>\n<p>      5. Having gone through the impugned concurrent judgments, I<\/p>\n<p>reckon that as an informed and fair stand taken by the learned counsel<\/p>\n<p>for the petitioner. I am satisfied that the verdict of guilty and<\/p>\n<p>conviction are absolutely justified.\n<\/p>\n<p>      6. Coming to the question of sentence, I find merit in the prayer<\/p>\n<p>for leniency.    I have already adverted to the principles governing<\/p>\n<p>imposition of sentence in a prosecution under Section 138 of the N.I.<\/p>\n<p>Act in the decision in <a href=\"\/doc\/163658\/\">Anilkumar v. Shammy<\/a> (2002 (3) KLT 852).<\/p>\n<p>In the facts and circumstances of the case, I     do    not find   any<\/p>\n<p>Crl.R.P.No. 9 of 2008<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>compelling reasons which can persuade this court to           insist on<\/p>\n<p>imposition of any deterrent substantive sentence of imprisonment on<\/p>\n<p>the petitioner.    At the same time justice must be shown to the<\/p>\n<p>complainant also.     The cheque for an amount of Rs. 2.97 lakhs is<\/p>\n<p>dated 7.8.2003. The complainant has been compelled by now to fight<\/p>\n<p>two rounds of legal battle and to wait for about 4 = years. Payment<\/p>\n<p>has still not been made to him. No civil action is initiated against the<\/p>\n<p>accused also, it is submitted.        I am satisfied that a substantive<\/p>\n<p>sentence of imprisonment till rising of court and an appropriate<\/p>\n<p>direction for payment of compensation shall eminently meet the ends<\/p>\n<p>of justice.\n<\/p>\n<p>      7. In the nature of the relief which I propose to grant, it is not<\/p>\n<p>necessary to wait for issue and return of notice to the respondent.<\/p>\n<p>      8. In the result:\n<\/p>\n<p>      (a) This revision petition is allowed in part.<\/p>\n<p>      (b)   The impugned verdict of guilty and conviction of the<\/p>\n<p>petitioner under Section 138 of the N.I. Act are upheld.<\/p>\n<p>Crl.R.P.No. 9 of 2008<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>     )    But the sentence imposed is modified and reduced.        In<\/p>\n<p>supersession of the sentence imposed on the petitioner by the courts<\/p>\n<p>below, he is sentenced to undergo imprisonment till rising of court.<\/p>\n<p>He is further directed under Section 357(3) Cr.P.C. to pay an amount<\/p>\n<p>of Rs.3,25,000\/-(Rupees three lakhs twenty five thousand only) as<\/p>\n<p>compensation and in default to undergo S.I. for a period of three<\/p>\n<p>months.\n<\/p>\n<p>        The modified sentence against the petitioner     shall not be<\/p>\n<p>executed till 29.2.2008. On or before 1.3.2008 the petitioner shall<\/p>\n<p>appear and the sureties shall produce him before the          learned<\/p>\n<p>Magistrate to undergo the modified sentence hereby imposed.<\/p>\n<p>                                           (R.
