Justice R.BASANT\n\n Dated :13\/10\/2008\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                     Crl.M.C.No.3727 of 2008\n                    ----------------------------------------\n             Dated this the 13th day of October 2008\n\n                               O R D E R\n<\/pre>\n<p>      The petitioner is the de facto complainant in crime<\/p>\n<p>No.122\/03 registered at the Kasaba police station, Kozhikode<\/p>\n<p>inter alia under Sections 120B and 420 I.P.C.                  The police<\/p>\n<p>conducted investigation and submitted a negative final report<\/p>\n<p>before the learned Chief Judicial Magistrate, Kozhikode. The<\/p>\n<p>same was registered as R.C.No.30\/06. The petitioner\/ de facto<\/p>\n<p>complainant raised objections against the acceptance of the refer<\/p>\n<p>report.   Simultaneously the petitioner filed a protest private<\/p>\n<p>complaint which was registered as C.M.P.No.1580\/2006. In such<\/p>\n<p>private complaint, enquiry was conducted. The sworn statement<\/p>\n<p>of the complainant and the witness were recorded. The learned<\/p>\n<p>Magistrate took up both R.C.No.30\/06 and C.M.P.No.1580\/06<\/p>\n<p>together for consideration and by the order dated 22\/3\/2007<\/p>\n<p>accepted the final report and dismissed the private complaint<\/p>\n<p>filed by the petitioner under Section 203 Cr.P.C.<\/p>\n<p>      2.   Aggrieved by that order, the petitioner preferred a<\/p>\n<p>revision before the court of Session and the learned Sessions<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3727\/08               2<\/span><\/p>\n<p>Judge by the impugned order dated 31\/3\/2008 upheld the order<\/p>\n<p>of dismissal of complaint passed by the learned Chief Judicial<\/p>\n<p>Magistrate under Section 203 Cr.P.C.         A second revision is<\/p>\n<p>legally not maintainable and the petitioner has hence chosen to<\/p>\n<p>come before this court by affixing the label of a petition under<\/p>\n<p>Section 482 Cr.P.C on the petition filed by him. The learned<\/p>\n<p>counsel for the petitioner had advanced his arguments.       The<\/p>\n<p>learned counsel for the petitioner submits that the impugned<\/p>\n<p>order passed under Section 203 Cr.P.C by the learned<\/p>\n<p>Magistrate and the rejection of the challenge against that order<\/p>\n<p>passed under Section 203 Cr.P.C by the learned Sessions Judge<\/p>\n<p>do both require interference by invoking the extraordinary<\/p>\n<p>inherent jurisdiction available to this court.<\/p>\n<p>      3.    The disputes have been inherited by the rival<\/p>\n<p>contestants from their predecessors. Respondents 1 to 4 are the<\/p>\n<p>legal heirs of the brother of the father of the petitioner. There<\/p>\n<p>was an agreement for sale of property between the predecessors.<\/p>\n<p>There was alleged breach of the terms of the said agreement.<\/p>\n<p>The petitioner&#8217;s predecessor was obliged to go to court in 1960<\/p>\n<p>with a suit for specific performance of the agreement. That suit<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3727\/08               3<\/span><\/p>\n<p>was decreed. Sale deed was executed by the court concerned.<\/p>\n<p>Proceedings came to an end on 22\/10\/1980, it is submitted by<\/p>\n<p>the learned counsel for the petitioner. Even in that decree for<\/p>\n<p>specific performance, delivery of the entire property was not<\/p>\n<p>effected. A portion of the property remains in the custody of the<\/p>\n<p>de facto complainant whereas a portion remains in the<\/p>\n<p>possession of accused 1 to 4.\n<\/p>\n<p>      4.    The next round of litigation commenced between the<\/p>\n<p>parties with the petitioner\/ de facto complainant claiming rights<\/p>\n<p>over the portion of the property which remained in the<\/p>\n<p>possession of accused 1 to 4. In such proceedings, the accused<\/p>\n<p>persons (accused 1 to 4 herein) claimed rights under a certificate<\/p>\n<p>of purchase issued in their favour by a competent authority<\/p>\n<p>dated 31\/10\/1978. In 2001, accused 1 to 4 executed a sale deed<\/p>\n<p>in favour of the 5th accused wherein they claimed title over the<\/p>\n<p>property as per the certificate of purchase dated 31\/10\/1978.<\/p>\n<p>Disputes about the validity of the said certificate of purchase<\/p>\n<p>have been raised in the pending civil litigation and final disposal<\/p>\n<p>of those civil proceedings has not yet taken place. It is at this<\/p>\n<p>juncture that the petitioner\/de facto complainant filed a<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3727\/08               4<\/span><\/p>\n<p>complaint before court alleging commission             of offences<\/p>\n<p>punishable inter alia under Sections 120B,448,468,471,418 and<\/p>\n<p>420 I.P.C.     That complaint was referred to the police under<\/p>\n<p>Section 156(3) Cr.P.C and the crime was registered by the<\/p>\n<p>police. Investigation was conducted. A negative final report was<\/p>\n<p>filed after completing the investigation in that crime.         It is<\/p>\n<p>thereafter that the protest complaint was filed and enquiry was<\/p>\n<p>conducted. The impugned order was passed thereafter after<\/p>\n<p>considering all relevant inputs dismissing the complaint and<\/p>\n<p>accepting the negative final report submitted by the police after<\/p>\n<p>due investigation.\n<\/p>\n<p>      5.    The learned Magistrate held and the learned Sessions<\/p>\n<p>Judge confirmed that sufficient ground to proceed with the<\/p>\n<p>matter has not been established by the petitioner\/de facto<\/p>\n<p>complainant.      The petitioner assails the said finding.    Called<\/p>\n<p>upon to explain the nature of challenge, the learned counsel for<\/p>\n<p>the petitioner fairly submits that the petitioner will be satisfied if<\/p>\n<p>cognizance is taken of the offence allegedly committed by the<\/p>\n<p>accused persons under Section 420 I.P.C.         That part of the<\/p>\n<p>grievance alone remains to be considered.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3727\/08                 5<\/span><\/p>\n<p>      6.    How can an offence under Section 420 I.P.C be said to<\/p>\n<p>be committed? There is no contention that the authority which<\/p>\n<p>issued the certificate of purchase is not legally competent to<\/p>\n<p>issue such purchase certificate. There is no contention that the<\/p>\n<p>purchase certificate has been tampered with or was not actually<\/p>\n<p>issued by such authority competent to issue the purchase<\/p>\n<p>certificate.   The crux of the contentions is that the purchase<\/p>\n<p>certificate has been obtained without revealing all the necessary<\/p>\n<p>details. It is further contended that as a matter of fact though<\/p>\n<p>such purchase certificate was allegedly obtained on 31\/10\/1978,<\/p>\n<p>the conduct of the accused persons not revealing such purchase<\/p>\n<p>certificate in the earlier civil proceedings is suspicious.<\/p>\n<p>      7.    I must alertly remind myself of the nature, quality and<\/p>\n<p>contours of the jurisdiction of this court when called upon to<\/p>\n<p>invoke and exercise the extraordinary inherent jurisdiction<\/p>\n<p>under Section 482 Cr.P.C. I must also take note of the nature of<\/p>\n<p>jurisdiction of the learned Magistrate at the stage of Section<\/p>\n<p>203\/204 Cr.P.C. The nature and ambit of the jurisdiction of the<\/p>\n<p>court of Session sitting as a court of revision exercising the<\/p>\n<p>powers under Section 397 Cr.P.C must also be alertly taken note<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3727\/08               6<\/span><\/p>\n<p>of.\n<\/p>\n<p>      8.    In short, the crux of the contentions is only that by<\/p>\n<p>raising wrong claims, the competent authority has been<\/p>\n<p>persuaded to issue a purchase certificate. The validity of the<\/p>\n<p>purchase certificate is admittedly being considered and is<\/p>\n<p>pending consideration of the civil court.\n<\/p>\n<p>      9.    In these circumstances, I have no hesitation to agree<\/p>\n<p>that the learned Magistrate was eminently justified in coming to<\/p>\n<p>the conclusion that sufficient grounds to proceed with the<\/p>\n<p>complaint raised under Section 420 Cr.P.C has not been made<\/p>\n<p>out. The court of revision was perfectly justified in coming to the<\/p>\n<p>conclusion that the said decision of the learned Magistrate does<\/p>\n<p>not warrant revisional interference. I am satisfied that, in any<\/p>\n<p>view of the matter, extraordinary inherent jurisdiction under<\/p>\n<p>Section 482 Cr.P.C does not deserve to be invoked in favour of<\/p>\n<p>the petitioner.\n<\/p>\n<p>      10.
