Justice ANTONY DOMINIC\n\n Dated :17\/08\/2010\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                    ================\n                W.P.(C) NO. 25824 OF 2010 (C)\n                =====================\n\n           Dated this the 17th day of August, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>      Prior to their entry in the Municipal Common Service,<\/p>\n<p>petitioners have rendered provisional service in the Health<\/p>\n<p>Department. Thereafter, they joined regular service in the<\/p>\n<p>Municipal Common Service prior to 1\/10\/94. Petitioners 1 and 2<\/p>\n<p>are presently posted in the 5th respondent and the 3rd petitioner is<\/p>\n<p>presently working under the 6th respondent. In this writ petition,<\/p>\n<p>what they claim is that the provisional services rendered by them<\/p>\n<p>should be reckoned for grant of higher grade. This claim is sought<\/p>\n<p>to be substantiated by referring to Exts.P3 and P5 judgments.<\/p>\n<p>Having gone through Exts.P3 and P5 judgments, I am inclined to<\/p>\n<p>think that this issue is covered in favour of the petitioners and<\/p>\n<p>therefore, they are entitled to succeed.<\/p>\n<p>      2.   I heard the standing counsel appearing for respondents<\/p>\n<p>5 and 6.\n<\/p>\n<p>      Having regard to the above, the writ petition is disposed of<\/p>\n<p>holding that the petitioners are entitled to have their provisional<\/p>\n<p>services in the Health Services Department reckoned for grant of<\/p>\n<p>WPC No. 25824\/10<br \/>\n<span class=\"hidden_text\">                              :2 :<\/span><\/p>\n<p>increments and higher grade.
