Justice K.K.DENESAN\n\n Dated :20\/11\/2006\n\n O R D E R\n                             K.K.DENESAN, J.\n\n                     -----------------------------\n\n                         WP(C)No. 26648 OF 2005\n\n                     -----------------------------\n\n                 Dated this the 20th November, 2006.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      Heard the counsel for the petitioners and the standing<\/p>\n<p>counsel for the respondents.\n<\/p>\n<p>      2.     The   petitioners   are   Part   Time   Sweepers   working   in<\/p>\n<p>the   Devaswom   Works   Department.     In   the   normal   course   they<\/p>\n<p>are   entitled   to   be   promoted   to   the   full   time   posts   and<\/p>\n<p>thereafter   to   the   post   of   Lascar.     In   the   Devaswom   Wing<\/p>\n<p>there   are   better   promotional   avenues   than   the   Works<\/p>\n<p>Department,   but   the   petitioners   are   not   given   appointment<\/p>\n<p>in  the  Devaswom  wing.   On  the  other  hand,  those  working  in<\/p>\n<p>the   Devaswom   wing   are   given   inter   unit   transfer   to   the<\/p>\n<p>Devaswom Works Department thereby affecting even the meagre<\/p>\n<p>promotional   avenues   available   to   the   Part   Time   Sweepers<\/p>\n<p>like   the   petitioners.     Against   the   above   action   of   the<\/p>\n<p>respondent-Board, this writ petition has been filed.\n<\/p>\n<p>      3.        In   the   statement   submitted   on   behalf   of   the<\/p>\n<p>respondent-Board   it   is   stated   that   a   list   of   Part   Time<\/p>\n<p>Sweepers   in   the   Maramath   wing   of   the   Devaswom   Board   is<\/p>\n<p>maintained and that persons who are working in the Devaswom<\/p>\n<p>wing   will  not  be  transferred  to  the   Devaswom Works<\/p>\n<p><span class=\"hidden_text\">WPC 26648\/2005                     2<\/span><\/p>\n<p>Department   as   apprehended   by   the   petitioners.
