THE CIRCLE OFFICER, BARARI, KATIHAR.\n                                  ----------------------------------\n<\/pre>\n<p>02.   15.09.2011             Heard learned counsel for the petitioner<\/p>\n<p>                   and the State.\n<\/p>\n<p>                             2. Petitioner was engaged to serve as a<\/p>\n<p>                   driver in the office attached to the Collectorate,<\/p>\n<p>                   Katihar. Such fact is evident from letter no.589 dated<\/p>\n<p>                   8.5.1989 issued by the Deputy Collector Incharge,<\/p>\n<p>                   Najarat, Katihar to the Circle Officer, Kohra, which is<\/p>\n<p>                   contained in Annexure-1 to this application. It is<\/p>\n<p>                   submitted on behalf of the petitioner that from<\/p>\n<p>                   17.06.1987 till the date of filing of the writ petition<\/p>\n<p>                   he continued to discharge the duty of a driver in the<\/p>\n<p>                   different offices attached to the Collectorate, Katihar<\/p>\n<p>                   but his engagement could not be regularized as he<\/p>\n<p>                   was engaged to discharge the duties of the driver on<\/p>\n<p>                   17.06.1987 after the cut off date i.e. 1.8.1985. The cut<\/p>\n<p>                   off date having been extended under resolution of the<\/p>\n<p>                   Government dated 10.5.2005 from 1.8.1985 to<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>11.12.1990 case of the petitioner is required to be<\/p>\n<p>considered    for   regularization    but   instead   of<\/p>\n<p>considering his regularization engagement of the<\/p>\n<p>petitioner was dispensed with after filing of the writ<\/p>\n<p>petition. In this connection, it is also pointed out with<\/p>\n<p>reference to the certificate bearing letter no.39 dated<\/p>\n<p>6.1.2005, Annexure-5 issued by the Circle Officer,<\/p>\n<p>Barari that the arrears of wages has not been paid to<\/p>\n<p>the petitioner.\n<\/p>\n<p>           3. Aforesaid two submissions has not been<\/p>\n<p>disputed in the counter affidavit filed on behalf of<\/p>\n<p>respondent nos.2, 3, whereunder instructions of the<\/p>\n<p>State Government bearing Memo No.15341 dated<\/p>\n<p>3.6.2006 has been annexed, wherefrom it appears that<\/p>\n<p>persons engaged to serve as daily wager after the<\/p>\n<p>extended cut off date i.e. 11.12.1990 were asked to be<\/p>\n<p>disengaged. Petitioner having been engaged prior to<\/p>\n<p>the cut off date and such fact having not been<\/p>\n<p>disputed in the counter affidavit, I have no option but<\/p>\n<p>to direct the Collector, Katihar to engage the<\/p>\n<p>petitioner as and when situation so requires to serve<\/p>\n<p>either as a Class-IV employee or as a Driver as per<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>          the exigencies of the requirement until his case is<\/p>\n<p>          considered for appointment\/regularization on the<\/p>\n<p>          Class-IV post or on the pose of Driver in the<\/p>\n<p>          Collectorate, Katihar\/attached offices.<\/p>\n<p>                    4. In the counter affidavit the State<\/p>\n<p>          respondents have not disputed the correctness of the<\/p>\n<p>          statement made in letter no.39 dated 6.1.2005,<\/p>\n<p>          Annexure-5 of the Circle Officer, Barari addressed to<\/p>\n<p>          the   Establishment       Deputy   Collector,   Katihar<\/p>\n<p>          informing the Establishment Deputy Collector that<\/p>\n<p>          arrears of wages is due to the petitioner from May,<\/p>\n<p>          2004. Let the Collector, Katihar verify whether any<\/p>\n<p>          arrears of wages is due to the petitioner from May,<\/p>\n<p>          2004 and if any amount is found due, the said amount<\/p>\n<p>          should also be paid to the petitioner as early as<\/p>\n<p>          possible, in any case within two months from the date<\/p>\n<p>          of receipt\/production of a copy of this order before<\/p>\n<p>          the Collector, Katihar.\n<\/p>\n<p>                    5. The writ application is, accordingly,<\/p>\n<p>          disposed of.\n<\/p>\n<\/p>\n<p>                                 ( V. N.
