This Writ Appeal is filed under Section 4 of the Karnataka
\nHigh Court Act praying to set aside the order passed in the writ
\npetition No.30637\/2002 dated 22.01.2008.\n<\/p>\n

the correctness of the same  The
\nlearned Single Judge adV\u20acTtll’l\u00ab._Cl:”t.OA t_he;_threevireliiefs as prayed at
\nprayer columns A, B and C xvvri-t_appxe’alyfagftler adverting to<\/p>\n
the rival legal conVtevnti}on’s  the parties, we<\/p>\n
examined   in this appeal with a
\nview to find out: appellant is entitled for the
\nsame. Insofar as”‘-vpriayer; in”v.cla’use B seeking to direct the first
\nresbonydesvi.t}\u00b0~tQ’-..A.:piepare”a'”‘seniority list of the appellant and to<\/p>\n
effectg_l_thel_”p.ro’nfioti’onishuas per rules applicable and to redo the<\/p>\n
in”p.romotio’n_s alrealdiyfilmade and further direction issued to the<\/p>\n
–.%_r’_esp’ongdents” prepare the seniority list and effect the<\/p>\n
 Api’o.n1otionsfthereafter in accordance with the rules applicable,<\/p>\n
.  is rejected by the learned single judge in the impugned<\/p>\n
 challenged in this writ appeal urging various grounds.<\/p>\n

4<\/span>\n<\/p>\n
2. The ground of attack of the impugned order by the<\/p>\n
smallest is that learned Single Judge did not consider the ground
\nurged in the writ petition insofar as the promotions of<\/p>\n
respondent Nos. 2 to 5 who are non–graduates under<\/p>\n
R Rules which was approved by the State <\/p>\n
could not have been promoted above the, cadre   it<\/p>\n
Under the new C & R Rules they canlnot1’_’_be’corrie_'”‘?’ng_iun’efers:,l–:,<\/p>\n
which is an Executive Grade–II posL,._V:To_ become\u00bb anti-.Eng’i’ii’ee’r by ” R<\/p>\n
promotion one has to be senior for.en\ufb01a_n”‘–.by sle’lectio,n’\u00a7. If the<\/p>\n
minimum experience of an empl.oytee.VAi’fix’ed:l_lower post for<\/p>\n
promotion is7i_:ai’e”:set ” ‘<\/p>\n
aside.\n<\/p>\n
4. Another ground  attack\ufb02of’ order is that the
\nlearned Single that the respondent
\ni\\los.2 to 5 were  the post higher than that
\nof the foremanunldierltr-e”‘O’id  and Recruitment Rules and
\nthey were not g.ualifier!._V_to’hoI:\u00bbj any post in the cadre of Assistant<\/p>\n
Manyagierirour abovej\ufb01iinder the new rules. Further the learned<\/p>\n
 singlel”‘j_ud’g__e ‘i\\~:hia’ve taken into consideration the above<\/p>\n
V\ufb01relevant alsipect ofvthe matter viz., once the rules do not provide<\/p>\n
l4_’fo’l~4.4’prornotionvot respondent i\\los.2 to S to the cadre of higher<\/p>\n
 of a foreman under the old C 8: R Rules to the<\/p>\n
‘%”””.:,V_post”of”lAssistant Manger under the New Rules, they cannot<\/p>\n
 the posts of the Deputy General Manager in the first<\/p>\n
iit_\/<\/p>\n
respondent–company. Non–consideration of this aspect of the<\/p>\n
matter by the learned singie judge has rendered the impVu’g_ned<\/p>\n
order erroneous in law and therefore, the same is |iabie._EQVVbe”iset<\/p>\n
aside.\n<\/p>\n
5. Except the respondent Nos.E.’ and  oth’etsv:..ate.:’3not <\/p>\n
graduates in the Engineering courses: -.V_Since\u00ab.th.eyV}are not
\ngraduates, they cannot becozn\u00e9  Manager of the
\nfirst respondent company. This.jasp’ec’:_o.i*”v_the1~y.’rnatter was not<\/p>\n
appreciated by the7_iea:{f’ned.,\u00a7ing.I_e }_uVdjge’.’u:’H’ence, the order is
\nerroneous in:’i’ayiii’andtheiifi-;’anfie.eVi:s iia’a_l’e'”to be set aside.\n<\/p>\n
6. Further the ie’a.rn’ed’S_ingyle\u00a2i-udge ought to have noticed that<\/p>\n
th\u00abe=fi_rst’respiogindent shou.i.c.i\u00ab’not have given promotion to them<\/p>\n
without’.p’reparatio’n::’of.the seniority list in the cadre. Promotions<\/p>\n
“”‘vi,_,,_h.ave tote’ effe.ci:_e5 in accordance with the C 8: R Rnies by<\/p>\n
_4\ufb02f.o_i4iowging the se_nior’:ty list. It is not open for the first respondent<\/p>\n
‘1._’i:’o.A__p=iT_a’ce Iagperson in the higher cadre under the C & R Ruies<\/p>\n
V’ i’.’wit’h’out’g;preparation of seniority iist and non-appreciation of this<\/p>\n
 of the :’\u00a7’%atter by the learned single judge rendered the<\/p>\n
\\’i\/<\/p>\n
order erroneous in law and therefore, the same is liable to be set<\/p>\n
aside.\n<\/p>\n
7. The learned counsel for the first resiizorident”ha’s..:sough’t.tog: <\/p>\n
justify the order passed by the iearnedi.4Si:n’g!e <\/p>\n
order of promotion given to respondent No-s..2 to   <\/p>\n
and 7 interalia contending that thep.apipe_li~ayVnt  no:t._AAeVntitled to
\nquestion the same before this”courtby{.1nit’i’a.tVi’:n:g’writ proceedings
\nbelatedly, after tong la\ufb02se of.-time:”‘fro~m::\u00bb.ythe;d.a’teof promotions
\ngiven to them.  iealrlned Single Budge
\nought to have  the writ petition.\n<\/p>\n
Further the actioniAoff’-“1-Vheiwfirst..l:re.spondent in promoting to the
\nrespondent Nos’. post is justified contending
\nthat the saign\u00e9 is in ai’c..c:ordanV:c:e ‘with the C & R Rules, no doubt<\/p>\n
Abeen approved by the State of Government<\/p>\n
 noneth”el_e’s.sp.th’e7g,pp~e’i’iant herein cannot challenge the same as<\/p>\n
l”.;–heVw_as ap’p–oint’ed=o:n a temporary basis in the year 1990 and he<\/p>\n
 the different departments of the first respondent-<\/p>\n
 the promotions were given to him. Hence, the<\/p>\n
E””‘~.l,_appeI’iarit cannot have any grievance against either the first<\/p>\n
i.\/<\/p>\n
respondent or promoted respondents to question their<\/p>\n
promotions.\n<\/p>\n

\nthe seniority list  the prayer of the appellant to

to the prorhgotvioiaz to ti*ie.._rl:\u00e9spoiident Nos.2 to 7 after quashing the<\/p>\n
order of’prornoitiony4\u00a7\u00ab–\u00a7._vei’i to them.<\/p>\n

 resplendent to file expianation, explaining under what<\/p>\n

  .t.c-F5 and 6 and 7, in the absence of Cadre 8: Recruitment<\/p>\n
