Sodhi, J.  <\/p>\n<p>1.     The  petitioner is aggrieved of the judgment and order of the  Central Administrative Tribunal, Principal Bench, New Delhi (for short &#8216;the  Tribunal&#8217;)  dated 24th May, 1999 in O.A. No.2016 of 1998, whereby the  Tribunal, following its earlier order dated 8th April, 1999, in O.A. No.2117 of 1998, Karan  Singh  and others Vs. Union of India, has disposed of  the  O.A.  in<br \/>\nterms thereof and set aside the dismissal of respondent No.1 while  directing him to be reinstated with 50 per cent back wages.\n<\/p>\n<p>2.   Brief facts of the case are that respondent No.1, a constable in Delhi Police, was dealt with under the provisions of the Delhi Police (Punishment and  Appeals) Rules 1980 vide Order No.2923-37\/HAP-North dated  10th  June, 1994  on the allegation that he absented himself from  duty  unauthorisedly for the following period:\n<\/p>\n<pre>         S.No    Period of Absence.\n        1.      12.8.87 to 23.9.87\n        2.      Absent for 24 days w.e.f. 18.12.97.\n        3.      16.6.88 to 27.10.88 (149 days)\n        4.      12.3.90 to 13.7.90\n        5.      3.8.90 to 29.5.91\n        6.      18.9.91 to 23.4.92\n        7.      23.4.92 to 3.3.93\n        8.      26.7.93 to 8.9.93\n\n \n\n<\/pre>\n<p>3.   That since the above act of respondent No.1 amounted to gross  misconduct, serious negligence and dereliction in discharge of duty and  unbecoming  a  member  of disciplinary force, rendered  himself  foe  disciplinary action. A regular departmental inquiry was ordered against him and entrusted to Mr.Raj Singh, SHO, vide Office Order No.2923-37\/HAP-North dated  10th June, 1994. The Enquiry Officer, upon completion of the inquiry,  submitted his finding holding respondent No.1 guilty of the charge. The  disciplinary authority, after complying with the requisite formalities, passed an  order of  dismissal  of respondent No.1 from service dated 13th June,  1996.  The respondent filed an appeal against the order of dismissal which was rejected by the appellate authority vide order dated 17th June, 1996 which  order was  taken  up in revision and rejected vide order dated 28th  July,  1998. Feeling  aggrieved  thereof, respondent No.1 moved the Tribunal by  way  of O.A.No.2016 of 1998 which was, in turn, disposed of by the Tribunal&#8217;s order dated  24th May, 1999 following its earlier order in O.A.No.2117  of  1998, Karan Singh Vs. Union of India, as already stated.\n<\/p>\n<p>4.   Since the only point in issue has already been decided by us today  in our  order  in  C.W.No.4883  of 1999  Deputy  Commissioner  of  Police  Vs.
