No.148 of 2011\n                            PANJO SINGH\n                                 Versus\n                         THE STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>04.   04.02.2011                Petitioner is apprehending his arrest in a<\/p>\n<p>                   complaint case in which cognizance has been taken<\/p>\n<p>                   under Sections 376\/34 and 504 of the I.P.C.<\/p>\n<p>                                It is alleged against this petitioner and one<\/p>\n<p>                   Rajeev Singh to have forcefully established physical<\/p>\n<p>                   relationship with the complainant.\n<\/p>\n<p>                                It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that accused No. 1 in the complaint petition<\/p>\n<p>                   is   the    nephew   of   the   complainant   whereas    this<\/p>\n<p>                   petitioner is the father-in-law of the accused No. 1. It is<\/p>\n<p>                   further submitted that accused No. 4 Sahdeo Singh<\/p>\n<p>                   filed   a   complaint     against   the   husband   of   the<\/p>\n<p>                   complainant on 17.0-6.2006 vide Complaint Case No.<\/p>\n<p>                   464(C ) of 2006 under Sections 341, 323, 392 of the<\/p>\n<p>                   I.P.C. as contained in Annexure-2 in which this<\/p>\n<p>                   petitioner was witness No. 4. Accused No. 4 also filed a<\/p>\n<p>                   police case against the husband of the complainant<\/p>\n<p>                   being Chandradeep P.S. Case No. 154 of 2006 on<\/p>\n<p>                   09.09.2006 and as a retaliatory measure the present<\/p>\n<p>                   complaint has been filed on 21.11.2006. It is further<\/p>\n<p>                   submitted that the occurrence alleged to have taken<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          place in the field but there is no eye witness to the<\/p>\n<p>          occurrence nor the complaint depicts that any medical<\/p>\n<p>          examination of the victim was done.\n<\/p>\n<p>                     Learned     A.P.P.     while   supporting   the<\/p>\n<p>          accusation submits that petitioner&#8217;s side lodged the<\/p>\n<p>          case prior to the present case.\n<\/p>\n<p>                     Considering the previous litigation between<\/p>\n<p>          the parties, nature of accusation against the family<\/p>\n<p>          members and their relations, let the petitioner namely<\/p>\n<p>          Panjo Singh, in the event of his arrest or surrender<\/p>\n<p>          before the Court below within a period of 12 weeks from<\/p>\n<p>          today, be released on anticipatory bail on furnishing<\/p>\n<p>          bail bond of Rs. 10,000\/-(ten thousand) with two<\/p>\n<p>          sureties of the like amount each to the satisfaction of<\/p>\n<p>          Chief Judicial Magistrate, Jamui in connection with<\/p>\n<p>          Complaint Case No. 1021(C ) of 2006.\n<\/p>\n<\/p>\n<pre>Shageer                               ( Dinesh Kumar Singh,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Panjo Singh vs The State Of Bihar on 4 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
