The State Government in<\/p>\n<p>                  the Rural Development Department framed Bihar Gramin Seva<\/p>\n<p>                  Sambarg Niyamabali, 2010 under Article 309 of the Constitution dated<br \/>\n<span class=\"hidden_text\">                                                                             2<\/span><\/p>\n<p>19.1.2010 (hereinafter referred to as \u201ethe appointment regulations\u201f).<\/p>\n<p>Rule 8(b) of the regulations provides for interim appointments pending<\/p>\n<p>regular appointments, when the interim appointments shall cease<\/p>\n<p>automatically. On 19.1.2010 the Rural Department issued a notification<\/p>\n<p>in exercise of powers under Rule 8(b) for filling up vacancies of Block<\/p>\n<p>Development Officers by such interim appointment for a duration of<\/p>\n<p>three years on deputation. On 6.2.2010 inclusive of a corrigendum an<\/p>\n<p>advertisement was issued by the Rural Development Department<\/p>\n<p>inviting applications from the holders of specified posts in the identified<\/p>\n<p>departments mentioned therein for appointment on the post of Block<\/p>\n<p>Development Officer.\n<\/p>\n<p>        Learned Counsel for the petitioners submits that fixing a cut off<\/p>\n<p>age limit of 52 years as eligibility to apply for such deputation is<\/p>\n<p>arbitrary. There is no rationale or logic behind fixation of this age limit. A<\/p>\n<p>person shall remain eligible and agile at the age of 53 years also. The<\/p>\n<p>second contention is that if the age limit is not enhanced, the petitioners<\/p>\n<p>may be compelled to work under their juniors who shall be appointed on<\/p>\n<p>deputation as Block Development Officer and shall supervise the works<\/p>\n<p>of the petitioners.\n<\/p>\n<p>        A classification based on age cannot per se be said to be<\/p>\n<p>arbitrary. If the classification is done arbitrarily without any logic or<\/p>\n<p>rationale there may be occasion for the Court to interfere but if the<\/p>\n<p>respondents urge a rationale and a logic it is not the jurisdiction of the<\/p>\n<p>Court under Article 226 of the Constitution to sit over the wisdom of the<\/p>\n<p>administrator and supplant its own views in place of the administrator.<\/p>\n<p>This Court in CWJC No. 6826 in a challenge arising out of the same<\/p>\n<p>rules has held as follows:-\n<\/p>\n<p><span class=\"hidden_text\">                                                                              3<\/span><\/p>\n<blockquote><p>               &#8220;The law stands well settled that it is for the employer<br \/>\n               to specify its own need for the kind of personnel it<br \/>\n               requires for discharge of specified nature of works.<br \/>\n               This Court cannot redefine the needs and eligibility<br \/>\n               specified by the Government as per its own<br \/>\n               understanding.&#8221;<\/p><\/blockquote>\n<p>        These observations were derived from the judgment of the<\/p>\n<p>Supreme Court in AIR 1990 SC 535 <a href=\"\/doc\/1431651\/\">(J. Ranga Swamy vs Government<\/p>\n<p>of Andhra Pradesh &amp; ors.<\/a>) which held at Para 6 as follows:-<\/p>\n<blockquote><p>                   &#8220;6. &#8230;&#8230;&#8230;&#8230;&#8230; It is not for the Court to consider the<br \/>\n                   relevance of qualifications prescribed for various<br \/>\n                   posts. &#8230;. There is nothing prima facie preposterous<br \/>\n                   about this requirements. It is not for us to assess the<br \/>\n                   comparative merits of such a doctorate and the BARC<br \/>\n                   diploma held by the petitioner and decide or direct<br \/>\n                   what should be the qualifications to be prescribed for<br \/>\n                   the post in question&#8230;..&#8221;<\/p><\/blockquote>\n<p>        Reliance as also further placed on (2002) 6 SCC 252 (State of<\/p>\n<p>Rajasthan vs. Lata Arun).\n<\/p>\n<p>        The respondents in their counter affidavit state that given the<\/p>\n<p>nature of duties to be performed by Block Development Officers,<\/p>\n<p>regular, frequent field visit with long stressful working hours are<\/p>\n<p>required. Healthy, young and energetic person are therefore better<\/p>\n<p>suited for the same.\n<\/p>\n<p>        The ground urged by the respondents can certainly not be<\/p>\n<p>classified as devoid of rationale and logic rendering it ipso facto<\/p>\n<p>arbitrary. Once reason has been furnished and those administrative<\/p>\n<p>reasoning have their own rationale and logic the court cannot start<\/p>\n<p>examining the sufficiency of the reasoning in exercise of powers of its<\/p>\n<p>judicial review.\n<\/p>\n<p>        The grievance that the petitioners may be asked to work under<\/p>\n<p>their juniors, does not persuade the Court to so lightly interfere with the<\/p>\n<p>scheme of the State Government which otherwise has been explained<br \/>\n<span class=\"hidden_text\">                                                                                   4<\/span><\/p>\n<p>        as it clearly carries a palliative for the petitioners that it is an interim<\/p>\n<p>        arrangement to cease after three years only. If this has been done in<\/p>\n<p>        the interest of administration and to ensure smooth continuity in<\/p>\n<p>        government scheme the Court shall not lightly interfere with the same.<\/p>\n<p>        However if the respondents do not stand by the original scheme of<\/p>\n<p>        keeping the post on deputation for three years only and seek to extend<\/p>\n<p>        it by giving it some kind of permanency or semi permanency surely the<\/p>\n<p>        petitioners shall have a legitimate grievance.<\/p>\n<p>               The writ application is dismissed with the aforesaid observation.<\/p>\n<pre>Snkumar\/-                                         (Navin Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Abbas Alam &amp; Ors vs The State Of Bihar &amp; Ors on 28 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.9047 of 2010 1.
