:\n<\/p>\n<p>(Per :\n<\/p>\n<p>HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>1.\t\tAll the<br \/>\napplications are for condonation of delay of 84 days in preferring<br \/>\nLetters Patent Appeals against the common judgment and the order<br \/>\ndated 7\/4\/2010 passed by the Ld. Single Judge of this Court in the<br \/>\nconcerned Special Civil Application. When the applications are taken<br \/>\nup for hearing, Ld. Counsel Mr. R.C. Kakkad for the applicant<br \/>\nUniversity has placed on record the letter dated 15\/1\/2011 received<br \/>\nby him from concerned AGP Mr. K.L. Pandya, who has to appear in the<br \/>\ncontempt proceedings, which is also pending before the Contempt Bench<br \/>\nof this Court. The said letter is  addressed by the Director, Indian<br \/>\nSystem of Medicine and Homeopathy, Gujarat State, Gandhinagar to the<br \/>\nGovernment Pleader&#8217;s office, High Court, stating that against the<br \/>\ndecision of the Ld. Single Judge of this Court, which is also<br \/>\nimpugned in the present group of Letters Patent Appeals, the Health<br \/>\nand Family Welfare Department had recommended for preferring Letters<br \/>\nPatent Appeals. However, the Legal Department of the State Government<br \/>\nhas not accepted the proposal and it is decided to accept the<br \/>\ndecision of the Ld. Single Judge.  In the said correspondence, it has<br \/>\nbeen further stated that the payment, as admissible to Shri D.M.<br \/>\nJoshi, who was also one of the petitioners in the said group, in<br \/>\nfurther acceptance of the judgment of the Ld. Single Judge  of this<br \/>\nCourt, has been disbursed.\n<\/p>\n<p>2.\t\tIn above view of<br \/>\nthe matter, we find that when the State Government has accepted the<br \/>\ndecision of the Ld. Single Judge of this Court, no cause would<br \/>\nsurvive to the appellant &#8211; University to pursue the Letters<br \/>\nPatent Appeals further. If the  Letters Patent Appeals are also not<br \/>\nto be pursued further, the question of condonation of delay would<br \/>\nautomatically not survive.\n<\/p>\n<p>3.\t\tHence, all the<br \/>\napplications for condonation of delay as well as the concerned<br \/>\nLetters Patent Appeal [Stamp] Nos., are disposed of as would not<br \/>\nsurvive in view of the aforesaid development.\n<\/p>\n<p>4.\t\tIn view of the<br \/>\naforesaid disposal of the main Letters Patent Appeals,  the interim<br \/>\nCivil Application [Stamp] Nos., in the respective Letters Patent<br \/>\nAppeal would also not survive and shall stand disposed of<br \/>\naccordingly.\n<\/p>\n<p>[<br \/>\nJAYANT PATEL, J. ]<\/p>\n<p>[<br \/>\nJ.C.
