Whether the judgment should be reported in the Digest?\n\n\nPresent:    Mr.Fariad Singh Virk, Advocate,\n            for the petitioner.\n\n                         *****\n\nRANJIT SINGH, J.\n<\/pre>\n<p>            The petitioner has filed this revision against the order of<br \/>\nhis conviction for an offence under Section 304-A IPC and the award<br \/>\nof RI for two years.\n<\/p>\n<p>            As per the prosecution story, Satpal Singh and Faqir<br \/>\nSingh were proceeding on a Motor Cycle No.PB-42A-6031, followed<br \/>\nby Amrik Singh son of Karnail Singh, resident of Chabba, Police<br \/>\nStation Gulha. When these two separate Motor Cycle riders reached<br \/>\nin the vicinity of Gobind Rice Mill, Samana, a Truck being driven at a<br \/>\nhigh speed, took a turn towards right and, thus, rammed against the<br \/>\nMotor Cycle driven by Satpal Singh. Satpal Singh and Faqir Singh<br \/>\nboth fell down. Amrik Singh and Gurbax Singh have stopped their<br \/>\nMotor Cycle and found Satpal Singh suffered multiple injuries. Faqir<br \/>\nSingh had also suffered multiple injuries. Satpal Singh died at the<br \/>\nspot. Amrik Singh had identified the Truck driver as Sahib Singh, who<br \/>\nafter the accident, managed to escape from the spot. Faqir Singh<br \/>\nwas taken to Civil Hospital where he succumbed to his injuries. The<br \/>\n<span class=\"hidden_text\"> CRIMINAL REVISION NO.2513 OF 2011 (O&amp;M)                       :2:<\/span><\/p>\n<p>case was registered leading to conviction. The appeal filed by the<br \/>\npetitioner was also dismissed.\n<\/p>\n<p>            Counsel says that the eye-witness account is a made up<br \/>\nstory. The counsel further contends that actually there was ample<br \/>\ndamage to the Motor Cycle, which would show that basically it is the<br \/>\nnegligence of the Motor Cycle rider that he came and struck into the<br \/>\ntruck. Except for baldly asserting that it is false story projected by the<br \/>\nprosecution, nothing else is pointed out as to how it is a false case.<br \/>\nThe case of the prosecution is supported by eye-witness account. It<br \/>\nis not possible to disbelieve it merely because the petitioner says that<br \/>\nit is a made up story. The aspect that negligence was on part of the<br \/>\nMotor Cycle rider would also not advance the case of the petitioner<br \/>\nas contributory negligence is no defence in criminal liability to assess<br \/>\nthe liability under Section 304-A IPC.
