Justice S.S.SATHEESACHANDRAN\n\n Dated :15\/07\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.19810 OF 2009\n           --------------------------\n      Dated this the 15th day of July 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The   petitioners  moved   an   application<\/p>\n<p>before the Sub Court, Trivandrum seeking permission<\/p>\n<p>to institute a suit under section 92 of Code of<\/p>\n<p>Civil Procedure.   Initially leave was tentatively<\/p>\n<p>granted but later on the same day suomotu that<\/p>\n<p>order was renewed holding that only the Principal<\/p>\n<p>Civil Court of original jurisdiction can grant<\/p>\n<p>permission to accord leave to institute the suit<\/p>\n<p>under  Section  92  of  Code  of  Civil  Procedure.<\/p>\n<p>Propriety  and   correctness  of  that   order   is<\/p>\n<p>impeached  by  the  petitioners in   this  petition<\/p>\n<p>invoking the supervisory jurisdiction vested with<\/p>\n<p>this court under Article 227 of the Constitution of<\/p>\n<p>India.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.19810 OF 2009     2<\/span><\/p>\n<p>          2.     I heard the learned counsel for the<\/p>\n<p>petitioners.       Since no notice on the application<\/p>\n<p>for leave had been issued by the court below I find<\/p>\n<p>notice to the respondents is not necessary, and it<\/p>\n<p>is dispensed with.        The learned counsel for the<\/p>\n<p>petitioner       inviting   my    attention  to    the<\/p>\n<p>notification published by the Government G.O (MS)<\/p>\n<p>384\/66dated 24\/10\/1966 published in the gazette<\/p>\n<p>dated 01\/11\/1966 submitted that Sub court is also<\/p>\n<p>having concurrent jurisdiction to grant leave and<\/p>\n<p>entertain a suit under Section 92 of Code of Civil<\/p>\n<p>Procedure within their jurisdiction.     Having regard<\/p>\n<p>to the words used in Sub Section (1) of Section 92<\/p>\n<p>that the suits       under Section 92 of Code of Civil<\/p>\n<p>Procedure can be instituted &#8221; in the Principal<\/p>\n<p>Civil Court of original jurisdiction or in any<\/p>\n<p>other court empowered in that behalf by the state<\/p>\n<p>Govt. within the local limits of whose jurisdiction<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.19810 OF 2009     3<\/span><\/p>\n<p>the whole or any part of the subject matter of the<\/p>\n<p>trust is situate to obtain a decree&#8221;        I find the<\/p>\n<p>submission      of    the  learned  counsel   for   the<\/p>\n<p>petitioner is well founded, and a reconsideration<\/p>\n<p>of the matter by the learned Sub Judge is called<\/p>\n<p>for.    So much so the declining of leave under the<\/p>\n<p>impugned order passed by the learned Sub Judge is<\/p>\n<p>set aside,     who is directed to consider the matter<\/p>\n<p>fresh.     Petitioner shall produce a copy of the<\/p>\n<p>notification referred       above before the court to<\/p>\n<p>enable the court to pass appropriate orders in<\/p>\n<p>accordance with law.
