M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr P. H. Pathak, learned counsel for the appellant and Mr<br \/>\nN.J. Shah, learned Asstt.Government Pleader for respondents No. 1 to\n<\/p>\n<p>3.<\/p>\n<p>2.\t\tWith<br \/>\nthe consent of the learned  counsel for the parties, we have taken<br \/>\nthis appeal for final disposal.\n<\/p>\n<p>.\t\tLearned<br \/>\ncounsel for the appellant has urged that he is ready to pay cost of<br \/>\nRs. 1,000\/- but he is not ready to pay cost of Rs. 1,000\/- per year<br \/>\nfor 13 years , Rs. 13,000\/- while the matter was pending before this<br \/>\ncourt.  We are of the opinion that  since the appellant did not<br \/>\nappear before the learned  Single Judge and, therefore, the learned<br \/>\nSingle Judge was fully justified in imposing cost on the appellant.<br \/>\nBut in our opinion, the cost of Rs. 1,000\/-  per annum for 13 years<br \/>\nis a bit too harsh.  Interest of justice would be served if we<br \/>\nrequest the learned Single Judge to consider the restoration of  the<br \/>\nSpecial Civil Application afresh.\n<\/p>\n<p>4.\t\tThe<br \/>\nappeal is allowed.
