No. 1896 of<\/p>\n<p>                  2009.\n<\/p>\n<p>                           The writ application has been filed by the petitioner for<\/p>\n<p>                  quashing the order dated 10.12.2008 contained in Memo No.<\/p>\n<p>                  897 passed by the District Programme Officer, Rohtas, whereby<\/p>\n<p>                  selection\/appointment of petitioner on the post of Anganbari<\/p>\n<p>                  Sewika for Gogahara Anganbari Centre has been cancelled<\/p>\n<p>                  and a direction has been issued to start the selection process of<\/p>\n<p>                  Anganbari Sewika afresh.\n<\/p>\n<p>                           Counsel for the petitioner submits that the impugned<\/p>\n<p>                  order has been by the District Programme Officer, Rohtas, who<\/p>\n<p>                  is not vested with such powers under the guidelines relating to<\/p>\n<p>                  selection of Anganbari Sewika. This issue has already been<\/p>\n<p>                  decided by the Division Bench in a decision report in 2010 (2)<\/p>\n<p>                  PLJR 374 (Prabha Kumari Devi Vs. The State of Bihar and<\/p>\n<p>                  Ors.).\n<\/p>\n<p>                           Considering these facts, the impugned order dated<\/p>\n<p>                  10.12.2008 contained in Memo No. 897 as well as the<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>           subsequent order issued by Child Development Project Officer,<\/p>\n<p>           Karagahar, Rohtas, vide Letter No. 41 dated 18.02.2010, are<\/p>\n<p>           quashed.\n<\/p>\n<p>                    The District Programme Officer, Rohtas, may submit<\/p>\n<p>           his report this matter, as provided under Clause 8 of the<\/p>\n<p>           guidelines. In the light of the decision report in 2010(2) PLJR<\/p>\n<p>           374(Prabha Kumari Devi Vs.
