Justice C.T.RAVIKUMAR\n\n Dated :27\/09\/2010\n\n O R D E R\n                       C.T.RAVIKUMAR, J.\n                        ----------------------------\n                     W.P.(C)No.29615 of 2010\n                        ----------------------------\n                   Dated 27th September, 2010\n\n                            JUDGMENT\n<\/pre>\n<p>           The grievance of the petitioners, who are retired<\/p>\n<p>employees of the Kerala State Electricity Board, is pertaining to<\/p>\n<p>the non-disbursement of gratuity payable to them under Payment<\/p>\n<p>of Gratuity Act, 1972.            As per the orders passed in<\/p>\n<p>G.C.Nos.57\/2005 &amp; 59\/2005 the second respondent found that the<\/p>\n<p>petitioners are entitled to get the balance of gratuity amount.<\/p>\n<p>The same was challenged by the third respondent before the first<\/p>\n<p>respondent in appeals. However, the first respondent dismissed<\/p>\n<p>the appeals, as is obvious from Ext.P2 series of orders.     At the<\/p>\n<p>time of filing of the said appeals, the third respondent had<\/p>\n<p>deposited the arrears of gratuity payable to the petitioners before<\/p>\n<p>the first respondent. Despite the dismissal of the appeals, no<\/p>\n<p>action was taken by the first respondent to disburse the gratuity<\/p>\n<p>amount already deposited by the third respondent. It is raising<\/p>\n<p>grievance against the action on the part of the first and second<\/p>\n<p>respondents in not disbursing the arrears of gratuity that this writ<\/p>\n<p>petition has been filed.\n<\/p>\n<p><span class=\"hidden_text\">WP(C).No.29615\/2010              2<\/span><\/p>\n<p>        2.
