No.17954 of 2008\n                              AMAR NATH SAH\n                                  Versus\n                            THE STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>3   14.07.2008                    Heard the learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                                  Earlier the prayer for bail of the petitioner was rejected.<\/p>\n<p>                 According to the allegation Ganja was recovered from the houses of a<\/p>\n<p>                 number of accused.       From Ram Babu Rai 20 Kg of Ganja, from<\/p>\n<p>                 Surendra Rai and Shankar Choudhary also Ganja involving commercial<\/p>\n<p>                 quantity were seized. From the house of the petitioner 61 Kg Ganja was<\/p>\n<p>                 recovered.\n<\/p>\n<p>                                  Submission is that the petitioner was not present at the<\/p>\n<p>                 time of occurrence. The prayer for bail of Ram Babu Rai was earlier<\/p>\n<p>                 rejected but later on he has been granted bail on 28.04.2008 in Cr.<\/p>\n<p>                 Misc. No.14493 of 2000. Surendra Rai in Cr. Misc. Case No.19736 of<\/p>\n<p>                 2007 and Shankar Choudhary in Cr. Misc. No.22982 of 2007 have also<\/p>\n<p>                 been granted bail. The petitioner was not arrested on the spot and<\/p>\n<p>                 similarly situated co-accused persons have been granted bail.<\/p>\n<p>                                  In the facts and circumstances, the petitioner       Amar<\/p>\n<p>                 Nath Sah is ordered to be released on bail on furnishing bail bond of<\/p>\n<p>                 Rs.10,000\/- (Ten thousand) with two sureties of the like amount each to<\/p>\n<p>                 the satisfaction of the Addl. Sessions Judge, Saran at Chapra in<\/p>\n<p>                 connection with Sonepur P.S. Case No.195 of 2006, (N.D.P.S. Case<\/p>\n<p>                 No.1 of 2007).\n<\/p>\n<\/p>\n<pre>    Mkr.
