Counsel for the petitioner is not in a position to<br \/>\nshow the rule, which is sought to be challenged, namely rule 7 of the<br \/>\nGujarat Electricity Regulatory Commission [Electricity Supply Code<br \/>\nand Related Matters] Regulation, 2005. The pertinent aspect is that<br \/>\nit is on account of the said challenge, the matter is placed before<br \/>\nthe Division Bench. Under the circumstances, we are unable to<br \/>\nentertain the challenge as sought to be canvassed.\n<\/p>\n<p>2.\t\tHowever,<br \/>\nhe voiced the apprehension that if the matter is not heard today, the<br \/>\ntesting of the meter shall be completed in the laboratory and he<br \/>\nfurther apprehends that a complaint may also be filed under the<br \/>\nIndian Electricity Act.\n<\/p>\n<p>3.\t\tWe<br \/>\ncannot examine the matter on hypothesis that the complaint would be<br \/>\nfiled. However, if the testing of the meter is to be made and the<br \/>\npetitioner is called upon to remain present, he may do so if he so<br \/>\ndesires on his own volition.
