RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n          W.P.(C).No.23397 of 2009-T\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n    Dated this the 17th day of August, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>The  petitioners   challenge   Exts.P2   and   P3<\/p>\n<p>Government Orders issued relating to revision of<\/p>\n<p>property tax. Those orders stand stayed by this<\/p>\n<p>Court in different matters. Later, the Government<\/p>\n<p>have withdrawn those orders and directions have<\/p>\n<p>been  issued   to  the   Local   Self  Government<\/p>\n<p>Institutions to recover property tax only under<\/p>\n<p>the existing laws. I do not, therefore, find any<\/p>\n<p>ground to entertain this writ petition. It is<\/p>\n<p>unnecessary in view of G.O.(Ms)No.140\/2009\/LSGD<\/p>\n<p>dated 22.7.2009 issued freezing Exts.P2 and P3<\/p>\n<p>until further orders.\n<\/p>\n<p>The petitioners, however, tried to project yet<\/p>\n<p>another  case.  This  is  that  the  revision  of<\/p>\n<p>property tax should have a nexus to the fair rent<\/p>\n<p><span class=\"hidden_text\">WP(C)23397\/09          -: 2 :-<\/span><\/p>\n<p> that may be fixed in terms of Act 2\/65. The<\/p>\n<p> controversies pending in different Courts relating<\/p>\n<p> to the rights and the power to fix fair rent under<\/p>\n<p> Act 2\/65, though projected by the petitioners, are<\/p>\n<p> irrelevant for the issue in hand since even the<\/p>\n<p> provisions of Act 2\/65 have essentially no bearing<\/p>\n<p> on    the   regulatory   provisions  governing the<\/p>\n<p> fixation of property tax. Rental value for the<\/p>\n<p> purpose of property tax and fair rent for the<\/p>\n<p> purpose of Act 2\/1965 cannot be mixed up to create<\/p>\n<p> a situation, in any manner, interfering with the<\/p>\n<p> legislative competence of      the State to   bring<\/p>\n<p> amendments to the imposition of property tax under<\/p>\n<p> the provisions of the Kerala Panchayat Raj Act or<\/p>\n<p> the Kerala Municipality Act. The writ petition<\/p>\n<p> fails. The same is accordingly dismissed.<\/p>\n<p>                       THOTTATHIL B.
