Justice P.S.GOPINATHAN\n\n% Dated :25\/11\/2009\n\n: O R D E R\n<\/pre>\n<p>                P.S.Gopinathan, J.\n<\/p>\n<p>    ==========================================<br \/>\n               Crl.R.P.3622 of 2009<br \/>\n    ==========================================<br \/>\n     Dated this the 25th day of November, 2009.<\/p>\n<p>                       ORDER<\/p>\n<p>1.The Judicial Magistrate of the First Class-II<\/p>\n<p> (Mobile), Kottayam in S.T.No.1368 of 2007 on his<\/p>\n<p> file   convicted  the   revision   petitioner for<\/p>\n<p> offence  under  Section   138  of  the  Negotiable<\/p>\n<p> Instruments   Act   and    sentenced   to   simple<\/p>\n<p> imprisonment  for  two   months  and   a  fine  of<\/p>\n<p> Rs.10,000\/-.   In Crl.A.417 of 2008, the above<\/p>\n<p> conviction and sentence was confirmed.    Now this<\/p>\n<p> revision petition.\n<\/p>\n<\/p>\n<p>2.Learned  counsel  for   the  revision  petitioner<\/p>\n<p> submitted   that   he   is   not   assailing   the<\/p>\n<p> conviction.     But the    sentence  is  assailed.<\/p>\n<p> According to the learned counsel, the revision<\/p>\n<p> petitioner is a man without any avocation.     In<\/p>\n<p> that  circumstance,  he   is  entitled  to  little<\/p>\n<p> leniency in sentence and that he is prepared to<\/p>\n<p> pay the cheque amount.      I find merit in the<\/p>\n<p><span class=\"hidden_text\">CRRP3622\/2009            -:2:-<\/span><\/p>\n<p>submission made by the learned counsel.     I find<\/p>\n<p>that the revision petitioner is entitled to a<\/p>\n<p>little leniency in sentence.     Even otherwise, a<\/p>\n<p>modification    of  the  sentence   is  absolutely<\/p>\n<p>warranted, because there is no provision in the<\/p>\n<p>impugned judgment to pay compensation to the<\/p>\n<p>first    respondent.   I   find  that sentence  of<\/p>\n<p>imprisonment    till rising    of the  court  with<\/p>\n<p>direction    to  pay  Rs.40,000\/-   to  the  first<\/p>\n<p>respondent as compensation would meet the ends of<\/p>\n<p>justice.\n<\/p>\n<p>In the result, this revision petition is allowed.<\/p>\n<p>While confirming the conviction, the sentence is<\/p>\n<p>modified to one of imprisonment till rising of<\/p>\n<p>the court and to pay Rs.40,000\/-, the cheque<\/p>\n<p>amount as compensation to the first respondent<\/p>\n<p>under Section 357(3) of the Code of Criminal<\/p>\n<p>Procedure.        In  default    of   payment   of<\/p>\n<p>compensation,    the  revision   petitioner  shall<\/p>\n<p><span class=\"hidden_text\"> CRRP3622\/2009             -:3:-<\/span><\/p>\n<p> undergo     simple imprisonment    for  four  months.<\/p>\n<p> Revision petitioner is granted six months time to<\/p>\n<p> pay   compensation     Till    then,  the  bail  bond<\/p>\n<p> executed by him shall remain in force.<\/p>\n<pre>sl.
