Ranka in both the matters is<br \/>\n\twife and respondent-Rajesh Maganlal Ranka is the husband, as per the<br \/>\n\tproceedings before the Family Court. In Family Suit No.132 of 2001,<br \/>\n\tjudgment and order was passed on the basis that there was mutual<br \/>\n\tdivorce to be taken under Section 13 of the Hindu Marriage Act, 1955<br \/>\n\tbut the case of the appellant was that in her place some other lady<br \/>\n\twas produced and the court was misled. When it came to the knowledge<br \/>\n\tof the appellant, the appellant preferred review application in the<br \/>\n\tproceedings and the Family Court dismissed the review application,<br \/>\n\tagainst which the present<br \/>\n\tappeals before this Court.\n<\/p>\n<p>We<br \/>\n\tmay record that as it was a dispute between the wife and husband, we<br \/>\n\thad referred the matter to the Mediation Center of this Court vide<br \/>\n\torder dated 11.05.2011 passed in Civil Application No.1522 of 2011<br \/>\n\tin First Appeal No.1321 of 2010, which reads as under:\n<\/p>\n<p>\tThe<br \/>\n\tapplication is for directing interim maintenance for applicant No.1\n<\/p>\n<p>\t&#8211; wife and applicant No.2 &#8211; daughter.\n<\/p>\n<p>\tWe have<br \/>\n\theard Mr.Belsare, ld.advocate for the applicants and Mr.Kotecha,<br \/>\n\tld.advocate for the respondent.\n<\/p>\n<p>\tIt was<br \/>\n\tsubmitted by Mr.Kotecha, at the outset fairly that, his client is<br \/>\n\tready to bear the maintenance of his daughter- applicant No.2.\n<\/p>\n<p>\tHence,<br \/>\n\tconsidering the facts and circumstances, we direct that the<br \/>\n\trespondent shall pay maintenance of Rs.3000\/- p.m. from May 2011<br \/>\n\tonwards, and the first maintenance shall be paid on or before<br \/>\n\t10.6.2011. It is further observed that the FDR with the State Bank<br \/>\n\tof India having maturity value of Rs.1,01,221\/-, shall continue to<br \/>\n\tremain as investment, and respondent undertakes to abide by the<br \/>\n\tsame.\n<\/p>\n<p>\tSo far<br \/>\n\tas the maintenance of applicant No.1- wife is concerned, we<br \/>\n\tfind that before this Court examines the aspects of right of<br \/>\n\tmaintenance of the wife or otherwise, since it is a dispute between<br \/>\n\thusband and wife, it would be just and proper, if the matter is<br \/>\n\treferred to the Mediation Centre for amicable settlement for all<br \/>\n\ttimes to come. Hence, office shall refer the matter to the Mediation<br \/>\n\tCentre. Attempt shall be made to settle the dispute between the<br \/>\n\tparties, preferably within a period of three months. Thereafter, if<br \/>\n\tthe dispute is not settled, matter shall be placed on judicial side<br \/>\n\tfor appropriate orders.\n<\/p>\n<p>\tUnder<br \/>\n\tthe circumstances, no decision is rendered on the aspects of the<br \/>\n\tentitlement of maintenance to the wife &#8211; applicant No.1<br \/>\n\therein. In the event the matter is not settled, it would be open to<br \/>\n\tthe applicant No.1 to move appropriate application for interim<br \/>\n\tmaintenance, if otherwise permissible in law.\n<\/p>\n<p>\tThe<br \/>\n\tapplication disposed of accordingly.\n<\/p>\n<p>\tIt<br \/>\n\tappears that thereafter before the Mediation Center the case was<br \/>\n\tregistered as Mediation Case No.43 of 2011 and ultimately a<br \/>\n\tsettlement has been arrived at between appellant No.1-wife and the<br \/>\n\trespondent-husband on 30.08.2011. There is a report of the mediator<br \/>\n\tand a xerox copy of the settlement is also forwarded with the<br \/>\n\treport.\n<\/p>\n<p>\tWhen<br \/>\n\tthe appeals are taken up for hearing appellant No.1, with her<br \/>\n\tadvocate Mr.Belsare, is present and the respondent-Rajesh Maganlal<br \/>\n\tRanka is also present, who has been identified by appellant No.1.<br \/>\n\tThey both confirmed that the settlement is entered into and<br \/>\n\taccordingly the matters may be disposed of. We find that when it is<br \/>\n\ta matter between the wife and husband and they have settled the<br \/>\n\tissue, the same can be allowed to operate.\n<\/p>\n<p>\tUnder<br \/>\n\tthe circumstances, the present appeals are disposed of in terms of<br \/>\n\tthe settlement dated 30.08.2011 made before the Mediation Center of<br \/>\n\tthis Court and admitted and confirmed by this Court. The rights of<br \/>\n\tthe parties shall stand governed as per the terms of the settlement<br \/>\n\tdated 30.08.2011.\n<\/p>\n<p>\tBoth<br \/>\n\tthe appeals are disposed of accordingly.
