The accused-petitioner has preferred this revision<\/p>\n<p>                        application against the judgment and order dated<\/p>\n<p>                        14.02.2002 passed by the learned 4th Additional<\/p>\n<p>                        Sessions Judge, Saran in Criminal Appeal No.29\/2001<\/p>\n<p>                        by which the judgment of conviction and sentence dated<\/p>\n<p>                        20.02.2001 passed by the Judicial Magistrate, Ist Class,<\/p>\n<p>                        Chapara in G.R. Case No.1870\/1994, Trial No.862 of<\/p>\n<p>                        2001 has been confirmed and the appeal has been<br \/>\n Patna High Court CR. REV. No.427 of 2002 dt.27-09-2011                           2<\/p>\n<p>                      dismissed.\n<\/p>\n<p>                              The prosecution case, in brief, is that on<\/p>\n<p>                      26.04.1994, the informant Ram Raj Rai was sitting at<\/p>\n<p>                      his door. The petitioner alongwith the co-accused were<\/p>\n<p>                      seen cutting palm trees standing on the land possessed<\/p>\n<p>                      by the informant. The informant alongwith his son<\/p>\n<p>                      Jaleshwar Rai went to his aforesaid field and protested.<\/p>\n<p>                      Thereafter, the co-accused Lagandeo Rai asked to kill<\/p>\n<p>                      him. His villager Narayan Chaudhary had climbed on<\/p>\n<p>                      the palm tree to cut palm leaves. As directed by the<\/p>\n<p>                      accused persons, he got down from the palm tree.<\/p>\n<p>                      Thereafter, the accused petitioner Harendra Raitaking<\/p>\n<p>                      fasuli, a sharp cutting weapon from the hand of Narayan<\/p>\n<p>                      Chaudhary and assaulted the informant on his left elbow<\/p>\n<p>                      and when his son Jaleshwar Rai made protest, the<\/p>\n<p>                      petitioner assaulted him on his right palm and right<\/p>\n<p>                      hand. The father and son sustained bleeding injury.<\/p>\n<p>                      Hearing Hulla of the informant, Jhakhar @ Jhagur Rai<\/p>\n<p>                      (P.W.2), Bacha Rai and wife of the informant<\/p>\n<p>                      Shayampati Devi came there at the place of occurrence<\/p>\n<p>                      and they found both the accused fleeing away from the<\/p>\n<p>                      place of occurrence. The villagers brought both the<br \/>\n Patna High Court CR. REV. No.427 of 2002 dt.27-09-2011                                 3<\/p>\n<p>                      injured at Revilganj Hospital. On the way of Revilganj<\/p>\n<p>                      hospital, the informant became unconscious. After 4 to 5<\/p>\n<p>                      days of the occurrence, he regained consciousness and<\/p>\n<p>                      he found himself admitted in P.M.C.H as indoor patient.<\/p>\n<p>                      He had also seen his son Jaleshwar Rai admitted in<\/p>\n<p>                      P.M.C.H. The Fardbeyan of the informant was recorded<\/p>\n<p>                      at P.M.C.H, Patna and forwarded it to the Officer-in-<\/p>\n<p>                      charge of Revilganj police station for investigation of<\/p>\n<p>                      the    case.     After     investigation,   charge-sheet   was<\/p>\n<p>                      submitted. Cognizance was taken. The petitioner was<\/p>\n<p>                      charged under Sections 148 and 326 of the I.P.C. and<\/p>\n<p>                      other accused were charged under Sections 147 and 326<\/p>\n<p>                      of the I.P.C. After trial, the petitioner was convicted<\/p>\n<p>                      under Sections 148 and 326 and the other accused were<\/p>\n<p>                      found guilty under Section 147 of the I.P.C. After<\/p>\n<p>                      hearing on the question of sentence, the petitioner was<\/p>\n<p>                      sentenced to R.I. for 3 years and a find of Rs.1000\/-<\/p>\n<p>                      under Section 326 of the I.P.C. and R.I. for six months<\/p>\n<p>                      under Section 148 of the I.P.C. and in default of<\/p>\n<p>                      payment of fine, to serve 3 months sentence. All the<\/p>\n<p>                      sentences to run concurrently. The petitioner filed Cr.<\/p>\n<p>                      Appal No.29\/2001 against the aforesaid judgment of<br \/>\n Patna High Court CR. REV. No.427 of 2002 dt.27-09-2011                              4<\/p>\n<p>                      conviction and sentence dated 20.02.2001 passed by the<\/p>\n<p>                      learned Judicial Magistrate, Ist Class, Chapra. After<\/p>\n<p>                      hearing, the appeal has been dismissed and the judgment<\/p>\n<p>                      of conviction and sentence passed by the learned<\/p>\n<p>                      Judicial Magistrate, 1st Class has been confirmed.<\/p>\n<p>                              The learned counsel for the petitioner has<\/p>\n<p>                      submitted that there is no material on the record to show<\/p>\n<p>                      that the petitioner has any criminal antecedent. The<\/p>\n<p>                      petitioner should have been granted the benefit of<\/p>\n<p>                      Probation of Offenders Act. The occurrence has taken<\/p>\n<p>                      place on 26.04.1994 and almost 17 years have passed.<\/p>\n<p>                      The accused petitioner has been suffering from mental<\/p>\n<p>                      agony and the sentence of the petitioner deserves to be<\/p>\n<p>                      modified. He further submits that the petitioner has also<\/p>\n<p>                      remained in custody for about 2 months.<\/p>\n<p>                             The learned counsel for the State submits that the<\/p>\n<p>                      petitioner has injured the informant and his son by a<\/p>\n<p>                      sharp cutting weapon and both of them had got their<\/p>\n<p>                      treatment in the P.M.C.H, Patna. Since the injury was<\/p>\n<p>                      grievous in nature, as such, the petitioner is not entitled<\/p>\n<p>                      to get the benefit under Section 360 Cr.P.C. or under the<\/p>\n<p>                      Probation of Offenders Act. However, she has fairly<br \/>\n Patna High Court CR. REV. No.427 of 2002 dt.27-09-2011                            5<\/p>\n<p>                      submitted that the sentence may be reduced.<\/p>\n<p>                              After hearing the learned counsels for both the<\/p>\n<p>                      parties and on perusal of the materials on record, it<\/p>\n<p>                      appears that the petitioner has been convicted and<\/p>\n<p>                      sentenced by the learned trial court, which has been<\/p>\n<p>                      upheld by the learned appellate court. There is no<\/p>\n<p>                      material on the record to show that the petitioner has<\/p>\n<p>                      any criminal antecedent. It appears from the record that<\/p>\n<p>                      the petitioner and his son had been in P.M.C.H, Patna<\/p>\n<p>                      for their treatment and must have spent money in their<\/p>\n<p>                      treatment. The accused petitioner has been suffering<\/p>\n<p>                      from mental agony for more than 17 years and has also<\/p>\n<p>                      served the sentence for about two months.<\/p>\n<p>                              Considering the facts and circumstances, in my<\/p>\n<p>                      opinion, it is fit case in which the sentence of the<\/p>\n<p>                      petitioner should be modified. The sentence of the<\/p>\n<p>                      petitioner is reduced to the period already undergone in<\/p>\n<p>                      custody and a fine of Rs.10,000\/-, which will be<\/p>\n<p>                      deposited in the trial court within a period of three<\/p>\n<p>                      months from the date of receipt of a copy of this order,<\/p>\n<p>                      failing which, the sentence of the petitioner as imposed<\/p>\n<p>                      by the learned trial court will revive and the petitioner<br \/>\n        Patna High Court CR. REV. No.427 of 2002 dt.27-09-2011                            6<\/p>\n<p>                             will be taken into custody by the learned trial court to<\/p>\n<p>                             serve out the remaining period of sentence of<\/p>\n<p>                             imprisonment. If the fine is realized, it will be payable<\/p>\n<p>                             to the informant and his son in equal share as they have<\/p>\n<p>                             suffered injuries due to occurrence.
