SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/07\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent application has been preferred by the applicant-Manubhai<br \/>\nDhirajlal Mehta permitting him to be joined as party respondent in<br \/>\nSecond Appeal No. 29\/2001.\n<\/p>\n<p>2.\tIt<br \/>\nis reported that the applicant-Manubhai Dhirajlal Mehta has expired<br \/>\nin the month of December, 2009.\n<\/p>\n<p>3.\tUnder<br \/>\nthe circumstances, as and when the proposed legal heirs of the<br \/>\napplicant are brought on record and they are able to  satisfy that<br \/>\nthe applicant was  required to be joined as party respondent in<br \/>\nSecond Appeal No. 29\/2001 and even after his death the cause survives<br \/>\nand the heirs of the applicant can be joined as party respondent, no<br \/>\nrelief can be granted in the present application.
