Mandal, S.C.-15 &amp;\n                                     Mr. Abdus Shakoor, A.C. to S.C.-15\n                                               -----------\n<\/pre>\n<p>05.   29.11.2010                 Heard learned counsel for the petitioner and<\/p>\n<p>                    learned counsel for the State.\n<\/p>\n<p>                                 The petitioner is aggrieved by the order dated<\/p>\n<p>                    5.2.2010 passed by the Divisional Commissioner, Saran At<\/p>\n<p>                    Chapra and the subsequent order dated 8.3.2010 by which<\/p>\n<p>                    his Public Distribution System license has been suspended<\/p>\n<p>                    and he has been directed to deposit Rs. 48,038\/-.<\/p>\n<p>                                 It is submitted that the petitioner came to this<\/p>\n<p>                    Court originally in C.W.J.C. No. 9369 of 2009 with the<\/p>\n<p>                    grievance that on account of non-supply of coupons he is<\/p>\n<p>                    unable to supply food grain articles meant for distribution<\/p>\n<p>                    under the Antadoya Yojana to the beneficiaries and has<\/p>\n<p>                    highlighted that articles are lying in the godown. The<\/p>\n<p>                    counter affidavit blamed the petitioner. The Writ Court<\/p>\n<p>                    declined to go into the allegations and counter allegations<\/p>\n<p>                    and directed the Divisional Commissioner to look into the<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>matter, fix responsibility and take appropriate action<\/p>\n<p>against the erring.\n<\/p>\n<p>          The    petitioner    claims   to    have   filed   his<\/p>\n<p>representation on 17.9.2009 enclosing the order of the<\/p>\n<p>Court.   He    asserts   in   paragraph-18    of   the   present<\/p>\n<p>application that when nothing further transpired he filed<\/p>\n<p>M.J.C. No. 13 of 2010 on 5.1.2010 for initiating contempt<\/p>\n<p>proceedings. Thereafter the leaned Commissioner issued<\/p>\n<p>notice to him on 3.2.2010 to appear before him for hearing.<\/p>\n<p>The notice did not state any date for appearance and<\/p>\n<p>hearing. It is asserted from paragraph-18 of the writ<\/p>\n<p>application that the notice was received by the petitioner<\/p>\n<p>on 4.2.2010. The next day i.e. 5.2.2010 was a Gazetted<\/p>\n<p>holiday and therefore the petitioner appeared on 6.2.2010<\/p>\n<p>and furnished all relevant materials. The petitioner on<\/p>\n<p>8.3.2010 received two orders that his license had been<\/p>\n<p>suspended and he was directed to pay the aforesaid<\/p>\n<p>amount based on the final order of the Divisional<\/p>\n<p>Commissioner dated 5.2.2010. Therefore the petitioner had<\/p>\n<p>been denied the opportunity to defend himself.<\/p>\n<p>          Learned counsel for the State submits that the<\/p>\n<p>order dated 8.3.2010 bearing no. 255 states that the<\/p>\n<p>Divisional    Commissioner     has   passed    the   order   on<\/p>\n<p>5.3.2010. Therefore 5.2.2010 being a Gazetted holiday is of<\/p>\n<p>no relevance. If the petitioner did not appear on 5.2.2010<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>considering the urgency of the matter as this Court had<\/p>\n<p>directed expedited disposal, he has only himself to blame.<\/p>\n<p>          The counter affidavit of the respondents does not<\/p>\n<p>deny the submission of the representation by the petitioner<\/p>\n<p>along with order dated 7.9.2009. Likewise, it is not in<\/p>\n<p>dispute that the respondents were galvanized into the<\/p>\n<p>action only after institution of the contempt application.<\/p>\n<p>The notice dated 3.2.2010 of the Divisional Commissioner<\/p>\n<p>fixed no date for hearing. The petitioner claims to have<\/p>\n<p>appeared on 6.2.2010 asserting that 5.2.2010 was a<\/p>\n<p>Gazetted holiday. All these facts have not been denied in<\/p>\n<p>the counter affidavit which simply states that they need<\/p>\n<p>no. The petitioner has brought on record the original copy<\/p>\n<p>of the order passed by the Divisional Commissioner. From<\/p>\n<p>the endorsement at the end, it is more than apparent that<\/p>\n<p>the date is 5\/2. The respondents in their counter affidavit<\/p>\n<p>have not even asserted that the Divisional Commissioner<\/p>\n<p>has not passed any order on 5.2.2010. They have not<\/p>\n<p>considered it necessary to bring on record the original<\/p>\n<p>order passed by the Divisional Commissioner which may<\/p>\n<p>have revealed as to whether the order was passed on<\/p>\n<p>5.2.2010 on 5.3.2010 as mentioned in the order dated<\/p>\n<p>8.3.2010 being no. 255. In the nature of the controversy<\/p>\n<p>created between the parties the failure of the respondents<\/p>\n<p>to deny the specific assertion of facts with regard to dates,<br \/>\n<span class=\"hidden_text\">                         4<\/span><\/p>\n<p>      this Court is left completely dissatisfied of fairness on part<\/p>\n<p>      of the Divisional Commissioner in passing order. The<\/p>\n<p>      notice dated 3.2.2010 was itself not in consonance with<\/p>\n<p>      law when it specified no date for hearing.\n<\/p>\n<p>                The order of the Divisional Commissioner dated<\/p>\n<p>      5.2.2010 is therefore set aside. Consequently, the orders<\/p>\n<p>      dated 8.3.2010 suspending his license and directing him to<\/p>\n<p>      deposit money also becomes non-sustainable and are set<\/p>\n<p>      aside.\n<\/p>\n<p>                The   matter   is   remanded   to   the   Divisional<\/p>\n<p>      Commissioner to fix a fresh date of hearing specifying in<\/p>\n<p>      notice to be issued by him, and then hear the petitioner<\/p>\n<p>      afresh and pass a reasoned and speaking order in<\/p>\n<p>      accordance with law preferably within a maximum period<\/p>\n<p>      of three months from the date of receipt\/production of a<\/p>\n<p>      copy of this order.\n<\/p>\n<p>                The application stands allowed.\n<\/p>\n<\/p>\n<pre>P.K                                    ( Navin Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kuber Prasad vs The State Of Bihar &amp;Amp; Ors on 29 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.5440 of 2010 1.
