Justice V.GIRI\n\n Dated :24\/08\/2009\n\n O R D E R\n                        V.GIRI, J.\n          ----------------------------------------\n                W.P.(C).No.17702 of 2009\n          ----------------------------------------\n         Dated this the 24th day of August, 2009.\n\n\n                       JUDGMENT\n<\/pre>\n<p>         The petitioner is the registered owner of a<\/p>\n<p>tipper lorry bearing registration No.KL-04\/P-7133.<\/p>\n<p>The vehicle was intercepted by the 2nd respondent on<\/p>\n<p>3.5.2009 alleging illicit transportation of river sand.<\/p>\n<p>According to the petitioner, the sand was being<\/p>\n<p>transported with a valid pass. A copy of the same has<\/p>\n<p>been produced as Ext.P1.          The petitioner further<\/p>\n<p>contends that the driver of the vehicle had handed<\/p>\n<p>over the original of Ext.P1 pass to the Sub Inspector.<\/p>\n<p>But, a copy of the seizure mahazar was not served on<\/p>\n<p>him. Ultimately, the District Collector conducted an<\/p>\n<p>enquiry and passed Ext.P4 order finding that there<\/p>\n<p>was illicit transportation of river sand and directing<\/p>\n<p>the petitioner to remit an amount of Rs.3,05,000\/-<\/p>\n<p>towards river management fund.            This has been<\/p>\n<p>challenged in this writ petition.<\/p>\n<p>W.P.(C).No.17702 of 2009<\/p>\n<p>                         :: 2 ::\n<\/p>\n<\/p>\n<p>         2.   Learned    Government      Pleader     has<\/p>\n<p>produced the files leading to Ext.P4. I heard learned<\/p>\n<p>counsel for the petitioner and learned Government<\/p>\n<p>Pleader.\n<\/p>\n<p>         3.   Learned counsel for the petitioner<\/p>\n<p>submits that the transportation of river sand was with<\/p>\n<p>the aid of a pass and if that be so, it cannot be<\/p>\n<p>considered as illicit.\n<\/p>\n<p>         4.   Learned Government Pleader submits<\/p>\n<p>that the photo copy of the pass itself shows that it was<\/p>\n<p>tinkered with.\n<\/p>\n<p>         5. I find force in the submission of the<\/p>\n<p>learned counsel for the petitioner that the District<\/p>\n<p>Collector ought to have, at least, considered the<\/p>\n<p>contention of the petitioner that the transportation of<\/p>\n<p>river sand was supported by a pass issued earlier. On<\/p>\n<p>a consideration, it might have been open to him to<\/p>\n<p>reject the said contention, if there were materials to<\/p>\n<p>show that the contention could not be accepted. But,<\/p>\n<p>W.P.(C).No.17702 of 2009<\/p>\n<p>                        :: 3 ::\n<\/p>\n<p>an authority exercising quasi judicial power<\/p>\n<p>cannot refuse to consider a vital contention and<\/p>\n<p>then conclude that there was infraction of the<\/p>\n<p>law.\n<\/p>\n<p>        6. In these circumstances, I am of the<\/p>\n<p>view that the matter requires reconsideration by<\/p>\n<p>the District Collector.\n<\/p>\n<p>        In the result, Ext.P4 is set aside and the<\/p>\n<p>writ petition is disposed of directing the District<\/p>\n<p>Collector to pass fresh orders in the matter of<\/p>\n<p>confiscation\/release   of     the vehicle  bearing<\/p>\n<p>registration No.KL-04\/P-7133. It is open to the<\/p>\n<p>petitioner to produce materials to show that the<\/p>\n<p>transportation of river sand, on the date in<\/p>\n<p>question, was legitimate and was supported by a<\/p>\n<p>pass issued in that regard.
