NO. 4168 OF 2004\n                 --------------------------------------------\n                 Dated this the 6th day of June, 2008\n\n                               JUDGMENT\n<\/pre>\n<p>     Petitioner    is   challenging     recovery      proceedings through<\/p>\n<p>attachment and sale of the property of the fourth respondent mortgaged<\/p>\n<p>to KSFE.     Petitioner&#8217;s claim is under agreement for purchase of<\/p>\n<p>mortgaged property. It is for the petitioner to settle arrears due to<\/p>\n<p>KSFE and then purchase the property or otherwise property can be sold<\/p>\n<p>in recovery proceedings. W.P. is disposed of leaving freedom to the<\/p>\n<p>KSFE to proceed for attachment and sale of property if the petitioner or<\/p>\n<p>defaulter does not settle liability immediately.<\/p>\n<p>                                       (C.N.
