DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/03\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nthe learned Advocate  for the  petitioner.\n<\/p>\n<p>2.\t\tThe<br \/>\nchallenge in this Revision Application filed under section 397 of the<br \/>\nCode of Criminal Procedure, 1973 (for short, &#8220;the Code&#8221;)<br \/>\nis the order  dated 19.9.2009 passed in Sessions Case No.94 of 2006<br \/>\npassed by the learned Additional Sessions Judge, 4th Fast Track<br \/>\nCourt, Rajkot  by which  charge under section 376  came to be added<br \/>\non the basis of deposition of the victim.\n<\/p>\n<p>3.\t\tMr<br \/>\nZubin Bharda, learned Advocate appearing for the petitioner and<br \/>\noriginal accused submits that the above deposition is a somersault<br \/>\nand   dramatic change  of version by the complainant and in fact in<br \/>\nearlier statement she had not disclosed such facts and on the<br \/>\ncontrary, it was stated therein that she had gone voluntarily  and<br \/>\nhad no grievance against the accused.\n<\/p>\n<p>4.\t\tIf<br \/>\nthe order impugned  is perused, the learned Judge exercised power<br \/>\nunder section 216 of the Code upon deposition of the victim which<br \/>\nreveals prima facie about the commission of the crime and,<br \/>\ntherefore, addition of section 376 of the Code as  additional charge<br \/>\nat this stage cannot be said to be contrary to law.\n<\/p>\n<p>5.\t\tNo<br \/>\n case is made out to interfere  with the impugned order and this<br \/>\nRevision Application is required to be dismissed and is accordingly<br \/>\ndismissed.\n<\/p>\n<p>[ANANT  S  DAVE J.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Parag vs State on 29 March, 2010 Author: Anant S.
