Justice M.N.KRISHNAN\n\n Dated :17\/03\/2010\n\n O R D E R\n                     M.N.KRISHNAN,J.\n             ======================\n                M.A.C.A No.1993 OF 2009\n             ======================\n         Dated this the 17th day of March 2010.\n\n                         JUDGMENT\n<\/pre>\n<p>     The owner and driver in spite of notice in the delay<\/p>\n<p>condonation application did not respond.      The Insurance<\/p>\n<p>Company has appeared. This is an appeal preferred against<\/p>\n<p>the award of the Motor Accidents Claims Tribunal, Wayanad<\/p>\n<p>Kalpetta in O.P.(MV) No.342\/2002. The claimant, a pillion<\/p>\n<p>rider in a two wheeler sustained injuries in a road accident<\/p>\n<p>and    Tribunal awarded     him Rs.7,150\/- and exonerated<\/p>\n<p>Insurance Company from the liability on the ground that<\/p>\n<p>that policy is only act only policy. Aggrieved by the same<\/p>\n<p>the claimant has come up in appeal.\n<\/p>\n<p>     2. Heard. The learned counsel for the appellant as well<\/p>\n<p>as the Insurance Company.          Learned counsel for the<\/p>\n<p>appellant had also made available before me for perusal a<\/p>\n<p>copy of the discharge summary issued by the         Medical<\/p>\n<p>College Hospital ,Kozhikode.      It can be seen that    the<\/p>\n<p><span class=\"hidden_text\">M.A.C.A No.1993 OF 2009          2<\/span><\/p>\n<p>claimant was admitted on 21.3.2002 and discharged on<\/p>\n<p>27.3.2002 and a surgery              called   tempero parietal<\/p>\n<p>craniotomy was done on 21.3.2002 and in the C.T scan it<\/p>\n<p>was revealed large axial heamatoema in the right parietal<\/p>\n<p>region with mass effect.         So surgery was done for the<\/p>\n<p>purpose of evacuating the same. The Tribunal has awarded<\/p>\n<p>a very nominal compensation of Rs.7,150\/-. Considering the<\/p>\n<p>nature of the injuries,       the claimant   would   entitled to<\/p>\n<p>additional compensation as follows:-<\/p>\n<p>       For    loss of earning    I grant  him Rs.1,000\/- more.<\/p>\n<p>Considering the nature of injury the treatment and the<\/p>\n<p>surgery, I award         Rs.5,000\/- more towards pain and<\/p>\n<p>suffering. Certainly it would have caused loss of amenities<\/p>\n<p>in life at least temporarily, for which I grant Rs.2,000\/- more<\/p>\n<p>making      an        additional  amount    of  Rs.8,000\/-   as<\/p>\n<p>compensation.\n<\/p>\n<p>      3. So far as     liability of the Insurance Company     is<\/p>\n<p>concerned since the vehicle is covered only by an act only<\/p>\n<p>policy applying the dictum in Tilak singh&#8217;s case 2006 (2)<\/p>\n<p><span class=\"hidden_text\">M.A.C.A No.1993 OF 2009      3<\/span><\/p>\n<p>KLT 884 (SC) united <a href=\"\/doc\/423517\/\">India Insurance Company Ltd. V.<\/p>\n<p>Tilak Singh, the Insurance Company<\/a> is not liable and that<\/p>\n<p>finding has to be confirmed as well.\n<\/p>\n<p>      In the result, the appeal is  partly allowed and the<\/p>\n<p>claimant     is   awarded an additional   compensation  of<\/p>\n<p>Rs.8,000\/- with 6% interest from the date of petition till<\/p>\n<p>realisation and respondents 1 and 2 are liable to pay the<\/p>\n<p>same.\n<\/p>\n<\/p>\n<p>                                   M.N.KRISHNAN,JUDGE.\n<\/p>\n<p>mns<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court T.K.Sivan vs Shaji K.J on 17 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM MACA.No. 1993 of 2009() 1.
