SHAH\n\t\t\n\t\n\n \n\nDate\n: 13\/05\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tPresent<br \/>\nRevision Application under Section 115 of the Code of Civil Procedure<br \/>\nhas been preferred by the petitioner herein   original claimant to<br \/>\nquash and set aside the impugned judgment and award dated 18th<br \/>\nAugust 2000 passed by the Motor Accident Claims Tribunal (Main),<br \/>\nPanchmahal, Gohara in Motor Accident Claim Petition No.1711\/1993 in<br \/>\nso far as it rejected the claim of the petitioner with respect to the<br \/>\ninterest from the insurance company from the date of application and<br \/>\nto hold that does the petitioner is entitled to recover the amount of<br \/>\naward alongwith 12% interest per annum from the date of application<br \/>\ntill realization from all the respondents including the insurance<br \/>\ncompany as all the respondents are jointly and severally liable.\n<\/p>\n<p>2.\tThat<br \/>\nthe petitioners herein   original claimants have preferred MACP<br \/>\nNo.1711\/1993 for claiming the compensation of Rs.9999\/- for the<br \/>\ninjuries suffered by him in the vehicular accident which took place<br \/>\non 23.06.1993.  That the learned Tribunal by its impugned judgment<br \/>\nand order dated 18th August 2000 partly allowed the said<br \/>\napplication directing the respondents to pay the compensation of<br \/>\nRs.7000\/- with interest at the rate of 12% per annum from the date of<br \/>\npetition till realization.  However, so far as the respondent No.3<br \/>\ninsurance company is concerned, the learned Tribunal passed the order<br \/>\nthat the respondent No.3   insurance company is liable to pay the<br \/>\ninterest from the date of 1st August 1999 till its<br \/>\nrealization as the insurance company was joined as a party respondent<br \/>\non 01.08.1999.  Being aggrieved and dis-satisfied with the impugned<br \/>\njudgment and award passed by the learned Tribunal in so far as<br \/>\nawarding the interest against the respondent No.3   insurance<br \/>\ncompany from the date of 1st August 1999 instead from the<br \/>\ndate of application, petitioner has preferred the present Civil<br \/>\nRevision Application under Section 115 of the Code of Civil<br \/>\nProcedure.\n<\/p>\n<p>3.\tHaving<br \/>\nheard learned advocates appearing on behalf of respective parties and<br \/>\nconsidering the decision of the Division Bench of this Court in the<br \/>\ncase of <a href=\"\/doc\/1745320\/\">Oriental Insurance Co. Ltd. v. Aminaben Rahimbhai Kadiwala<\/a><br \/>\nreported in 2001(2) G.L.H. 23,<br \/>\nit appears that the controversy in the present Revision Application<br \/>\nis squarely covered by the aforesaid decision.  As held by the<br \/>\nDivision Bench in the aforesaid decision, even if the insurance<br \/>\ncompany has been impleaded subsequently as a party in the Tribunal,<br \/>\nit cannot be absolved by its liability for interest of the<br \/>\nintervening period.  Under the circumstances, the impugned order<br \/>\npassed by the learned Tribunal in holding the respondent No.3<br \/>\ninsurance company liable to pay the interest only from 01.08.1999<br \/>\ntill its realization, cannot be sustained and deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, Revision Application is allowed.   The impugned<br \/>\njudgment and order dated 18.08.2000 passed by the Motor Accident<br \/>\nClaims Tribunal (Main), Panchmahal, at Godhara in MACP No.1711\/1993<br \/>\nis hereby modified to the extent of holding that the respondent No.3<br \/>\n  insurance company is liable to pay interest on the amount of<br \/>\ncompensation from the date of submitting the MACP till its<br \/>\nrealization.  Petitioner shall be entitled to the differential amount<br \/>\nfrom the respondent No.3 accordingly.  Rule is made absolute to the<br \/>\naforesaid extent.
