PUBLIC PROSECUTOR for\nRespondent. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\t\tThis<br \/>\nis an application under Sec.439 of the Code of Criminal Procedure,<br \/>\n1973 by the applicant who came to be arrested in connection with  CR<br \/>\nNo. I-60 of 2009 registered with Chuda police station,<br \/>\nDistrict-Surendranagar for the offence punishable under Sections 409,<br \/>\n465, 467, 468, 471 and 114 of Indian Penal Code.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>P.M. Thakkar, learned senior counsel at the outset submitted that the<br \/>\ntotal  amount involved in the present case is approximately Rs.<br \/>\n6,03,264\/- and a co-accused has been released by this Court by order<br \/>\ndated 12.03.2010 passed in Criminal Misc. Application No. 1777 of<br \/>\n2010 on condition of depositing Rs.3.00 lacs [Rupees Three Lacs]<br \/>\nbefore the trial court. He further submitted that the applicant is<br \/>\nready and willing to deposit the remaining Rs.3.00 lakhs subject to<br \/>\nhis rights and contentions that may be raised before the trial court.<br \/>\nConsidering the aforesaid aspect and the role attributed to the<br \/>\napplicant which is reflected in the FIR, he deserves to be enlarged<br \/>\non bail.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>K.P. Raval, learned Additional Public Prosecutor on the other hand<br \/>\nsubmitted that the applicant is facing charge for the offence<br \/>\npunishable under Sections 409, 465, 467, 468, 471 and 114 of Indian<br \/>\nPenal Code. Considering the peculiar facts and circumstnaces of the<br \/>\ncase, the applicant cannot claim parity with the co-accused released<br \/>\nvide order dated 12.03.2010 passed in Criminal Misc. Application No.<br \/>\n1777 of 2010. He submitted that considering the  role played by the<br \/>\napplicant and the manner in which the offence is committed by him, no<br \/>\ndiscretionary relief be granted and the application be dismissed.\n<\/p>\n<p>\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. Having considered the rival submissions and on perusal<br \/>\nof  the averments made in the application, role attributed to the<br \/>\napplicant which is reflected in the FIR, willingness of the applicant<br \/>\nto deposit the amount of Rs. 3.00 lakhs [Rupees Three Lakhs] before<br \/>\nthe trial court, provisions of sections 409, 465, 467, 468, 471 and<br \/>\n114 of IPC  and quantum of punishment etc., I am of the view that the<br \/>\napplicant deserves to be enlarged on bail without discussing the<br \/>\nevidence in detail.\n<\/p>\n<p> \tFor<br \/>\nthe foregoing reasons, the application is allowed and the applicant<br \/>\nis ordered to be enlarged on bail in connection with CR No. I-60 of<br \/>\n2009 registered with Chuda Police Station, District-Surendranagar, on<br \/>\nhis his depositing an amount of Rs.3.00 Lacs [Rupees Three Lacs]<br \/>\nbefore the trial court within one week from the date of his release<br \/>\nand on executing a bond of Rs.10,000\/- [Rupees ten thousand only]<br \/>\nwith one surety of the like amount to the satisfaction of the Trial<br \/>\nCourt and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p> \tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\t\tThe<br \/>\namount of Rs. 3.00 Lacs that may be deposited by the applicant before<br \/>\nthe trial court shall be invested by the trial court in a Fixed<br \/>\nDeposit in any nationalized bank in the name of Registrar of the<br \/>\ntrial court for a period of five years and on expiry of the period of<br \/>\nfive years,  the same shall be renewed from time to time till the<br \/>\ntrial is over.\n<\/p>\n<p>\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<pre>mathew\t\t\t\t\t\t[H.B.\nANTANI, J.]\n\n    \n\n \n\t   \n      \n      \n\t    \n\t\t   \u00a0\u00a0\u00a0\n\t   \n      \n\t  \t    \n\t\t   Top\n\t   \n      \n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Indravadanbhai vs State on 10 February, 2011 Author: H.B.Antani,&amp;Nbsp;
