Justice M.SASIDHARAN NAMBIAR\n\n Dated :03\/08\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.2533 OF 2009\n              ------------------------------------------\n\n               Dated        3rd August          2009\n\n\n                           O R D E R\n<\/pre>\n<p>           Petitioners are accused in C.C.1861\/2008 on<\/p>\n<p>the  file  of   Judicial          First       Class      Magistrate-I,<\/p>\n<p>Thrissur. First respondent is the defacto complainant.<\/p>\n<p>Learned  Magistrate      has      taken       cognizance      for  the<\/p>\n<p>offence under Sections 498 A, 354 and 323 read with<\/p>\n<p>Section 34 of Indian Penal Code on Annexure-A final<\/p>\n<p>report submitted     after investigation. This petition<\/p>\n<p>is  filed  under   Section        482      of     Code    of  Criminal<\/p>\n<p>Procedure  to quash the proceedings in C.C.1861\/2008<\/p>\n<p>stating  that   matrimonial            dispute          between  first<\/p>\n<p>respondent  wife   and      first       petitioner        husband  and<\/p>\n<p>petitioners  2  to     5,     his     relatives         were  amicably<\/p>\n<p>settled along with settlement of other proceedings<\/p>\n<p>pending before the Family court, under Annexure-B<\/p>\n<p>agreement  and in such circumstances,                  in the interest<\/p>\n<p>of   justice,    proceedings              pending         before   the<\/p>\n<p>Magistrate is also to be quashed.\n<\/p>\n<p>         2.   First      respondent           appeared      through  a<\/p>\n<p>CRMC 2533\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>counsel and    filed an affidavit stating that dispute<\/p>\n<p>with petitioners were amicably settled and   she has no<\/p>\n<p>objection for quashing the proceedings in view of the<\/p>\n<p>settlement.\n<\/p>\n<p>          3.  Learned counsel appearing for petitioners<\/p>\n<p>and first respondent and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>          4.  Annexure-B   agreement  entered  into  by<\/p>\n<p>first petitioner and first respondent establish that<\/p>\n<p>there was a settlement of all the disputes between the<\/p>\n<p>husband and wife as well as the relatives       and the<\/p>\n<p>marriage was agreed to be dissolved and proceedings<\/p>\n<p>pending before the Family court was settled. It also<\/p>\n<p>shows that there was an agreement to withdraw this case<\/p>\n<p>pending before    Judicial First Class Magistrate as<\/p>\n<p>C.C.1861\/2008 pursuant to the settlement.<\/p>\n<p>          5.  Offences alleged against petitioners are<\/p>\n<p>matrimonial offence as well as offences  connected with<\/p>\n<p>the matrimonial offence.    When from the affidavit of<\/p>\n<p>first  respondent  and  Annexure-B    agreement,  it is<\/p>\n<p>absolutely clear that there was a settlement of all the<\/p>\n<p>disputes between petitioners and first respondent and<\/p>\n<p>first respondent is not willing to proceed with the<\/p>\n<p>CRMC 2533\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>case, even if petitioners are to be tried, there is no<\/p>\n<p>chance    of  a   successful   prosecution.   In    such<\/p>\n<p>circumstances, as held by  the Apex court in <a href=\"\/doc\/1442974\/\">Madan Mohan<\/p>\n<p>Abbot v. State of Punjab<\/a> (2008 (3) KLT 19 (SC), it is<\/p>\n<p>not in   the  interest  of  justice    to  continue  the<\/p>\n<p>proceedings in view of settlement.<\/p>\n<p>          Petition is allowed.
