Justice K.K.DENESAN\n\n Dated :19\/02\/2007\n\n O R D E R\n                               K.K.DENESAN, J\n\n                    -------------------------------------------------\n\n                       W.P.(C)NO.34272  of 2006\n\n                    -------------------------------------------------\n\n\n\n            Dated this the 19th   day  of  February, 2007\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>      The   petitioner   was   appointed   as   Hospital   Attender   in   the<\/p>\n<p>Government   Ayurveda   Dispensary.   The   designation   of   the<\/p>\n<p>petitioner   is   wrongly   shown   in   the   writ   petition   as   Hospital<\/p>\n<p>Attendant. This wrong statement will go to the root of the matter,<\/p>\n<p>for   nomenclature   of   the   post   is   the   most   relevant   factor.   The<\/p>\n<p>former   post   viz.,   Hospital   Attendant     is   included   in   the   special<\/p>\n<p>rules     i.e.   Kerala   Indigenous   Medicine   Subordinate   Service<\/p>\n<p>(amendment)   Rules   1983.   Under   the   above   rules,   Attender<\/p>\n<p>Grade-I     is   category   11   and   Attender   Grade   II   is   category   12.\n<\/p>\n<p>Hospital   Attendant   in   the   Health   Services   Department   is   a   post<\/p>\n<p>coming within the last grade service.\n<\/p>\n<p>      2. One of the methods of recruitment to the post of Hospital<\/p>\n<p>Attendant as laid down in the Last Grade Service Rules is direct<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34272\/2006                                            :2:<\/span><\/p>\n<p>recruitment   from   candidates   sponsored   by   the   Employment<\/p>\n<p>Exchange hands as well, whereas the post of Attender Grade II<\/p>\n<p>which comes  within the subordinate  service is  a promotion post<\/p>\n<p>of last grade service people.  As far as posts within the last grade<\/p>\n<p>service are concerned, Rule 9 of KS&amp;SSR has no application. The<\/p>\n<p>post   of   Attender   Grade   II   which   comes   within   the   subordinate<\/p>\n<p>service is governed by Rule 9 as also the other provisions of the<\/p>\n<p>KS&amp;SSR. The petitioner was appointed as per Ext.P1 order for a<\/p>\n<p>period of 179 days. Evidently, the term prescribed has relevance<\/p>\n<p>in the context of Rule 9, as aforesaid. The term of the service of<\/p>\n<p>the petitioner was extended as per Ext.P2, on completion of 179<\/p>\n<p>days,  making   it   clear   that  the   further   term  will   also  be for   179<\/p>\n<p>days or Public Service Commission hands join duty.\n<\/p>\n<p>        3.  The   contention   raised  by  the  petitioner  is   based  on   the<\/p>\n<p>decision   of   this   Court   in  Vasanthi  v  state  of  Kerala  (2006(1)<\/p>\n<p>KLT 288). Necessarily, the thrust  is on the rights available under<\/p>\n<p>the  provisions  of   the  Special   Rules  for    Last  Grade  Service.   For<\/p>\n<p>reasons aforesaid, the said rules will not have any application to<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34272\/2006                                            :3:<\/span><\/p>\n<p>the facts of this case. On the other hand, the provision which has<\/p>\n<p>application   is   Rule-9     of   KS&amp;SSR.   That   being   the   position,   the<\/p>\n<p>petitioner   cannot   contend   that   she   is   eligible   to   continue   in<\/p>\n<p>service,   as though, she has been appointed on a regular basis.\n<\/p>\n<p>The   distortion   of   facts   by   the   petitioner   to   mislead   this   Court<\/p>\n<p>deserves to be taken serious note of and dealt with by imposing<\/p>\n<p>exemplary   costs.   I   dismiss   this   writ   petition.   However,without<\/p>\n<p>any   order   as   to   costs,   because   the   petitioner   hails   from   poor<\/p>\n<p>circumstances and what she could gain is wages  for a few more<\/p>\n<p>days   work   in   one   of   the   lowest   categories   in   service;   on   the<\/p>\n<p>strength   of   the   interim   order.
