                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                            CR. APP (SJ) No.588 of 2011\n                                  Ram Sagar Mahto\n                                         Versus\n                                  The State Of Bihar\n                                       -----------\n<\/pre>\n
3.   15.7.2011             The prayer for bail of the appellant has been<\/p>\n
                 considered on receipt of the lower court records.<\/p>\n
                                  The contention is that the prosecution was<\/p>\n
                 launched through a petition of complaint and admittedly there<\/p>\n
                 was a dispute for some bamboo clumps between the parties as<\/p>\n
                 has been admitted by P.W. 1 the father-in-law of the prosecutrix.<\/p>\n
                 It is also admitted that appellant Ram Sagar Mahto was the<\/p>\n
                 cousin of the husband of the complainant and further there was<\/p>\n
                 nothing found by the Doctor who examined the lady. There was<\/p>\n
                 a police case initially which was found to be not true after<\/p>\n
                 investigation.\n<\/p>\n
                                  Regard being had to the contentions, let appellant<\/p>\n
                 Ram Sagar Mahto be directed to be released, during pendency of<\/p>\n
                 this appeal, on furnishing a bond of Rs. 10,000\/- (ten thousand)<\/p>\n
                 with two sureties of the like amount each to the satisfaction of<\/p>\n
                 the trial court , i.e., Additional Sessions Judge, Fast Track Court-<\/p>\n
                 VII, Sitamarhi, in Sessions Trial No. 347 of 2010.<\/p>\n
                                  As regards the sentence of fine, realisation thereof<\/p>\n
                 shall remain stayed till further orders.\n<\/p>\n<\/p>\n
