[ORAL)<\/p>\n<p>             The petitioner seeks quashing of the orders dated<\/p>\n<p>16.10.2008 and 30.1.2009 [Annexures P-3 and P-8] whereby the<\/p>\n<p>possession of his residenti8al house bearing No. 14, Ward No. 2,<\/p>\n<p>Indri, District Karnal, has been taken and the same is being put to<\/p>\n<p>auction for recovery of arrears of loan amount.<\/p>\n<p>             Suffice it to note that according to the Bank, the petitioner<\/p>\n<p>has taken a house loan in addition to Cash Credit Limit and Over-<\/p>\n<p>Draft   facility   from   the    respondent    Bank.    According   to   the<\/p>\n<p>respondents, the petitioner&#8217;s loan liability, at present is not less than<\/p>\n<p>Rs.8 lacs. The petitioner, on the other hand, has disputed the<\/p>\n<p>Statement of Accounts. However, the said controversy need not be<\/p>\n<p>gone into by this Court as the matter is already pending before the<\/p>\n<p>Debts Recovery Tribunal, Chandigarh.\n<\/p>\n<p>               The only limited issue raised in this writ petition pertains<\/p>\n<p>to the delivery of possession of the petitioner&#8217;s residential house.<\/p>\n<p>              After arguing the case for some time, learned counsel for<\/p>\n<p>the parties have agreed for disposal of this writ petition in the<\/p>\n<p>following terms:-\n<\/p>\n<blockquote><p>      [i]     the petitioner undertakes to pay a sum of Rs. 10 lacs to<\/p>\n<p>              the respondent Bank on or before 18.2.2009;<\/p>\n<p>      [ii]    in case the petitioner deposits the afore-stated amount of<\/p>\n<p>              Rs.10 lacs, the respondent Bank shall deliver possession<\/p>\n<p>              of the said residential house on the very next day, i.e.,<\/p>\n<p>              19.2.2009;\n<\/p><\/blockquote>\n<blockquote><p>      [iii]   however, if the petitioner deposits the afore-stated<\/p>\n<p>              amount of Rs.10 lacs even before 18.2.2009, the<\/p>\n<p>              respondent is directed to re-deliver the possession of the<\/p>\n<p>              house to the petitioner either on the same day or before<\/p>\n<p>              noon on the next day;\n<\/p><\/blockquote>\n<blockquote><p>      [iv]    the petitioner further undertakes to pay another sum of<\/p>\n<p>              Rs.10 lacs on or before 7.3.2009;\n<\/p><\/blockquote>\n<blockquote><p>      [v]     besides the entire arrears of house loan amount which<\/p>\n<p>              the petitioner is required to deposit before 30.4.2009, he<\/p>\n<p>              shall deposit another sum of Rs.10 lacs before the said<\/p>\n<p>              date with the respondent Bank. The balance amount<\/p>\n<p>              including interest, if any, shall be deposited by the<\/p>\n<p>              petitioner before 30.8.2009;\n<\/p><\/blockquote>\n<blockquote><p>      [vi]    if the petitioner continues to deposit the installments as<\/p>\n<p>              per the Schedule, given above, the respondent Bank shall<\/p>\n<p>              not take possession of the house nor would it put any<br \/>\n                 mortgaged property of the petitioner to auction;<\/p>\n<p>         [vii] the petitioner shall deposit the afore-stated installments<\/p>\n<p>                without prejudice to his right in the pending case before<\/p>\n<p>                the DRT, Chandigarh;\n<\/p><\/blockquote>\n<blockquote><p>         [viii] the petitioner, however, shall be entitled to dispose of the<\/p>\n<p>                mortgaged properties in association with the Bank in such<\/p>\n<p>                a manner that the entire sale proceeds are directly paid to<\/p>\n<p>                the Bank;\n<\/p><\/blockquote>\n<blockquote><p>         [ix]   symbolic     possession   of   the   mortgaged     properties,<\/p>\n<p>                however, shall continue to remain with the respondent<\/p>\n<p>                Bank only.\n<\/p><\/blockquote>\n<blockquote><p>                Disposed of.\n<\/p><\/blockquote>\n<blockquote><p>                Dasti.\n<\/p><\/blockquote>\n<p>February 11, 2009.
