Sushila Paliwal, Public Prosecutor for\nthe respondent\/State.<\/pre>\n<p>     Heard both the parties.\n<\/p>\n<p>     Case diary of Crime No.180\/2010 registered<br \/>\nat Police Station Kolar Road District Bhopal for the<br \/>\noffence punishable under Section 420 read with<br \/>\nSection 34 of IPC is perused.\n<\/p>\n<p>     The applicant is apprehending his arrest in<br \/>\nthe aforesaid crime.\n<\/p>\n<p>     Learned counsel for the applicant submits<br \/>\nthat the present applicant is the Chairperson of<br \/>\none Ganga Vihar Grih Nirman Sahakari Samiti<br \/>\nMaryadit, Bhopal (for short &#8220;Society No.1&#8221;). He<br \/>\nhas purchased 0.80 acres of land for the Society<br \/>\nfrom Sarva Dharam Grih Nirman Samiti, Bhopal<br \/>\n(for short &#8220;Society No.2&#8221;) for a consideration of<br \/>\nRs.15 lakhs. Some of the members of the Society<br \/>\nNo.2 have lodged an FIR regarding cheating and<br \/>\nmisappropriation of their funds. In this connection<br \/>\nthe enquiry report is quite clear. There is no<br \/>\nallegation against the present applicant except<br \/>\nthat he purchased the aforesaid land. The entire<br \/>\nmatter is connected with the Society No.2 and<br \/>\nthere is no allegation that the present applicant<br \/>\n has purchased that land in lesser price. Actually<br \/>\nthe    applicant    has   purchased      the    land   for<br \/>\nbetterment of the members of his Society i.e.<br \/>\nSociety No.1. He has paid the actual cost of the<br \/>\nland in question and there is no allegation in the<br \/>\nreport that cost of the land was high. He has<br \/>\nnowhere connection with the Society No.2 and,<br \/>\ntherefore, he is not the culprit for the alleged<br \/>\ncrime. He further submits that the Chairperson of<br \/>\nthe Society No.2 i.e. Munnawar Khan Kousar and<br \/>\none Nitin Agrawal were enlarged on anticipatory<br \/>\nbail by this Court and the act of the present<br \/>\napplicant is inferior to the act of those two<br \/>\npersons, therefore he prays for anticipatory bail.\n<\/p>\n<p>       On the other hand learned Public Prosecutor<br \/>\nfor the State vehemently opposes the application<br \/>\nmainly on the ground that Munnawar Khan Kousar<br \/>\nand Nitin Agrawal have received anticipatory bail<br \/>\nin connection with Crime No.170\/2010 and not in<br \/>\nthe present crime. She further submits that there<br \/>\nare so many cases against these colonizers and the<br \/>\ncase    of   the   present   applicant    may    not   be<br \/>\nconsidered in a light manner.\n<\/p>\n<p>       Keeping in view the submissions made by<br \/>\nlearned counsel for the parties and the facts and<br \/>\ncircumstances of the case, I am of the view that<br \/>\nthis is a fit case for grant anticipatory bail to the<br \/>\napplicant. Consequently, this application under<br \/>\n           Section 438, Cr.P.C. is hereby allowed. It is<br \/>\n          directed that in the event of arrest, applicant Ajay<br \/>\n          Prakash      Jain    shall   be    released    on    bail   on<br \/>\n          furnishing    a     personal      bond   in   the    sum    of<br \/>\n          Rs.50,000\/- (Rupees fifty thousand) with a solvent<br \/>\n          surety in the like amount to the satisfaction of the<br \/>\n          Arresting Authority.\n<\/p>\n<p>               The applicant shall further abide by the<br \/>\n          conditions    enumerated          in   sub-Section    (2)   of<br \/>\n          Section 438 of Cr.P.C.\n<\/p>\n<p>               This order shall remain in force for a period of<br \/>\n          30 days and in the meanwhile, if the applicant so<br \/>\n          desires, may move an application for regular bail<br \/>\n          before the competent Court.\n<\/p>\n<p>               C.C. as per rules.\n<\/p>\n<p>                                                        (N.K.Gupta)<br \/>\n                                                           Judge<\/p>\n<p>Ansari.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Ajay Prakash Jain vs The State Of Madhya Pradesh on 18 August, 2010 M.Cr.C.
