  This
\nappeal is by the complainants seeking enhancement of the amount of compensation
\nawarded to them on account of death of
\nHitesh Kotak caused by the negligence
\nof the first respondent.. First
\nappellant-complainant is the widow of Hitesh Kotak, second appellant is the
\nminor child, third is the mother. They
\nwould be legal heirs of the deceased Hitesh Kotak. Fourth appellant is the father of the deceased and the fifth is
\nthe National Consumer Protection Samiti, an NGO. There are four respondents.
\nFirst respondent is the doctor against
\nwhom negligence is alleged. Respondent
\nNos. 2 and 3 were employees working
\nunder him and the fourth
\nrespondent is the National Insurance Company Ltd. who had given cover of the
\ninsurance to the first respondent for Rs.5.00 lakhs.\n<\/p>\n
  None
\nof the respondents have challenged the findings of negligence against the first
\nrespondent which caused the death of
\nHitesh Kotak a young man of 31 years of age.
\nAt the time of his death Hitesh was employed in a private firm
\ncalled Ashok Buildwell and Developers
\nPvt. Ltd., Nasik and was drawing a
\nmonthly salary of Rs.4061\/-. Home
\ntaking salary was Rs.3705\/- after deduction of Rs.356\/-. Hitesh Kotak was an engineer. After having held that the death of Hitesh was caused due to medical
\nnegligence of the first respondent, State Commission examined the question of
\nquantum of compensation. This is how
\nState Commission considered this aspect:\n<\/p>\n
Regarding
\nthe amount of compensation claimed by the complainant, it is an established
\nprinciple of law that compensation awarded u\/s 14(1)(d) of the Consumer Protection Act must have
\nrational relation to the nature and extent of injury, inconvenience or physical
\nand mental suffering caused to the complainant by the action or omission of the opposite party. In our considered opinion the complainants have failed to prove that the deceased had a permanent
\nemployment. On the contrary it is an
\nadmitted fact that he was in present
\njob since 2 months only. The complainants
\nhave produced only his last salary slip but it does not clarify that he was on
\npermanent basis and they have not produced any other evidence in this
\nregard. It may also be noted here that
\nit is the case of the complainants that the deceased was suffering from some
\nserious cardiac ailment. In that view
\nof the matter the burden is upon the
\ncomplainants to establish the life expectancy of the deceased which they failed
\nto prove by expert medical evidence or
\nany other evidence. In our considered
\nopinion, in the aforesaid circumstances the decision of the Honble High Court
\nof Gujarat in case of Ritaben and Anr.
\nVs. Ahmedabad Municipal Transport Service and Anr. 2000 ACJ 153 will
\nhardly have any application to the
\npresent case. It is the complainants
\ncase that deceased Hitesh suffered from heart ailment. It is therefore clear that in all
\nprobability he would not have lived the normal life span of life or even
\nreasonable span of life. The
\ncatastrophe of termination of his life had already set in much before he was treated by the opponent no.1 doctor. In that view of the matter, this will be a fit case to award some reasonable
\nlump sum compensation instead of working out compensation on the basis of
\neither multiplier method or any other method based on working of compensation for a person of normal
\nhealth. In above view of the
\nmatter, we are only left with an option to award reasonable lump sum
\ncompensation. In our considered
\nopinion Rs.50,000 (Rupees Fifty Thousand only) with interest @ 10% p.a. will be
\nreasonable to meet the ends of justice. We also proposed to impose cost of this
\ncomplaint which may be quantified Rs.2000\/-.\n<\/p>\n
  We
\nare sorry to observe that State Commission has totally misdirected itself. Human life
\nis precious. It was lost on
\naccount of negligence in the treatment.
\nThe age of the deceased was only
\n31 years. He left behind a widow, a minor child and parents. He was earning Rs.4061\/- per month and had every possibility of increase in his
\nsalary with better prospect. Persons with heart ailment do survive for a longer period than what has been
\nopined by the State Commission. How
\nlong Hitesh Kotak would have
\nsurvived we do not find any answer in
\nthe reasoning of the State Commission.
\nWith a family of five members to
\nlook after Hitesh Kotak must be spending over 2\/3rd of his salary for their maintenance
\nincluding himself keeping apart a
\ncertain portion of his salary exclusive for himself. Looking into the provisions of
\nthe Motor Vehicles Act and other relevant provisions and the general law
\nin considering how much
\nharassment and loss would have
\ncaused to the complainants on account of negligence of the first respondent, we
\nare of the view an award of Rs.5.00
\nlakhs would meet the ends of
\njustice.\n<\/p>\n
  We would, therefore, enhance the
\namount of compensation from
\nRs.50,000\/- to Rs.5.00 lakhs.\n<\/p>\n
Rest of the order of the order
\nof the State Commission regarding interest, cost etc. is sustained. Accordingly, we will further direct as under:\n<\/p>\n
(i) The amount of Rs.5.00 lakhs
\nshould be deposited by the 4th
\nrespondent-Insurance Company with the State Commission within four weeks of the
\nreceipt of this order less any amount if already deposited.\n<\/p>\n
(ii) Out of the amount of Rs.5.00 lakhs, Rs..1.50 lakhs each shall be paid to Smt. Hemina
\nHitesh Kotak, widow of the deceased and Smt. Bhanumati Rameshchandra Kotak,
\nmother of the deceased. The balance of Rs.2.00 lakhs shall be deposited
\nin the fixed deposit receipt in a Nationalised
\nBank for the welfare of the minor
\nchild Shivam Hiteshbhai Kotak.\n<\/p>\n
  State Commission shall give appropriate direction as to how
\nthe amount of FDR will be utilized as
\nand when any request is made by the mother of the child.\n<\/p>\n
  The
\nappeal is accordingly allowed.\n<\/p>\n
Complainants shall be entitled
\nto cost which we assess at Rs.5,000\/- Out of the cost so realized  <\/p>\n
one-half shall be paid to the National Consumers Protection Samiti and
\none-half to Smt. Hemina Hitesh Kotak,
\nwidow of the deceased.\n<\/p>\n
