Her late husband<\/p>\n<p>purchased a plot from the Greater Cochin Development Authority<\/p>\n<p>(GCDA for short) for their residential house. Amounts are due to<\/p>\n<p>be paid to the GCDA in respect thereof. Although the petitioner<\/p>\n<p>disputed the quantum fixed, the petitioner decided to pay the<\/p>\n<p>same under protest subject to her right to challenge the excess<\/p>\n<p>demand. Presently she only wants facility to pay the amount in<\/p>\n<p>instalments. She therefore, tendered twelve post-dated cheques<\/p>\n<p>to the second respondent for the amount demanded. But the<\/p>\n<p>respondents returned the same and by Ext.P5 the petitioner was<\/p>\n<p>informed that she cannot be given facility to pay the amounts in<\/p>\n<p>instalments. It is under the above circumstances, the petitioner<\/p>\n<p>has filed this writ petition seeking the following relief:<\/p>\n<blockquote><p>        &#8220;i.    issue a Writ of Certiorari or such other writ,<br \/>\n        direction or order quashing Exhibit P-5 and allow the<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.22200\/10                2<\/span><\/p>\n<p>         petitioner to pay the amount of Rs.1,51,928\/-<br \/>\n         demanded by way of Exhibit p-3 in 12 monthly<br \/>\n         instalments&#8221;.<\/p><\/blockquote>\n<p>      2.    I   have heard the learned Standing            Counsel<\/p>\n<p>appearing for the respondents also. After getting instructions,<\/p>\n<p>the learned Standing Counsel submits that the respondents are<\/p>\n<p>prepared to permit the petitioner to pay the amount demanded<\/p>\n<p>in twelve equal monthly instalments including interest up to<\/p>\n<p>date of payment of the last instalment, on the diminishing<\/p>\n<p>principal amount in accordance with the agreement between<\/p>\n<p>the parties for allotment of the plot.\n<\/p>\n<p>      3.    Accordingly, this writ petition is disposed of with the<\/p>\n<p>following directions:\n<\/p>\n<p>      The petitioner shall pay the amounts demanded in twelve<\/p>\n<p>equal monthly instalments starting from 1\/8\/2010.            Every<\/p>\n<p>subsequent instalment shall be paid on the first working day of<\/p>\n<p>every succeeding month. I make it clear that the petitioner<\/p>\n<p>would be liable to pay interest on the diminishing balance<\/p>\n<p>outstanding amount until the entire amount is paid off. The<\/p>\n<p>interest shall be paid in accordance with the agreement<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.22200\/10              3<\/span><\/p>\n<p>executed between the parties for the allotment of the plot. If<\/p>\n<p>the petitioner defaults payment of any one instalment, it would<\/p>\n<p>be open to the respondents to recover the entire amount in a<\/p>\n<p>lump sum by coercive proceedings. If the petitioner pays the<\/p>\n<p>instalments in time without default, no coercive recovery<\/p>\n<p>proceedings shall be initiated against the petitioner. I further<\/p>\n<p>make it clear that this is without prejudice to the right of the<\/p>\n<p>petitioner to challenge the quantum appropriately.<\/p>\n<p>                                   S.
