It is submitted that throughout the pendency of the<br \/>\n\tSpecial Case, since 1988, till he came to be convicted by the<br \/>\n\tSpecial CBI Court, he was on bail and he did not misuse the liberty.<br \/>\n\tIt is further submitted that after the applicant came to be<br \/>\n\tconvicted and sentenced, he preferred above-referred criminal appeal<br \/>\n\tbefore this Court and vide order dated 17.04.2009 passed in Criminal<br \/>\n\tMisc.Application No.1453 of 2009, the sentence awarded to the<br \/>\n\tapplicant &#8211; appellant &#8211; original accused came to be<br \/>\n\tsuspended on the condition of his furnishing personal bond as well<br \/>\n\tas surety, and upon deposit of his passport before the trial  Court.<br \/>\n\tMr.Shah, ld.advocate submitted that pursuant to said condition, the<br \/>\n\tapplicant deposited his passport before the trial Court. Mr.Shah,<br \/>\n\tld.advocate for the applicant &#8211; appellant stated that after<br \/>\n\tgetting back the passport from the trial Court, the applicant shall<br \/>\n\thave to undergo necessary formalities regarding visa etc. and after<br \/>\n\tperforming said formality, he would be in a position to go out of<br \/>\n\tIndia. Mr.Shah, ld.advcoate for the applicant, therefore, submitted<br \/>\n\tthat, at this stage, the permanent deletion of the condition<br \/>\n\tregarding the deposit of passport is not requested, but that<br \/>\n\tcondition may be, at present, suspended atleast for three months, so<br \/>\n\tthat the applicant can go out of India to perform his religious<br \/>\n\tceremony of Umra and return back within that period, and he<br \/>\n\tundertakes to re-deposit his passport as soon as the period of three<br \/>\n\tmonths shall be over, and as soon as he would get visa, he would<br \/>\n\tfile in writing his time schedule in this matter. It is submitted<br \/>\n\tthat now the applicant intends to go for religious visit in Umra<br \/>\n\tand, therefore, he is in need of the passport. Therefore, it is<br \/>\n\tsubmitted that the application may be allowed.\n<\/p>\n<p>\tMs.Shah, ld.APP<br \/>\n\tfor the respondent No.1 &#8211; State and Mr.Ravani, ld.advocate for<br \/>\n\trespondent No.2 &#8211; CBI submitted that the condition regarding<br \/>\n\tdeposit of passport should not be permanently deleted and the<br \/>\n\tapplicant should file his time schedule in this matter.\n<\/p>\n<p>\tHaving considered<br \/>\n\tthe submissions advanced on behalf of both the sides, so also<br \/>\n\tconsidering the contents of this application as well as the order<br \/>\n\tdated 17.04.2009 passed in Criminal Misc.Application No.1453 of<br \/>\n\t2009, this Court is of the opinion, at this stage, that, since the<br \/>\n\tmain criminal appeal is pending, the condition laid down at the time<br \/>\n\tof suspension of sentence requiring the applicant to deposit his<br \/>\n\tpassport before the trial Court, cannot be permanently deleted.<br \/>\n\tHowever, considering the facts and circumstances of the case, so<br \/>\n\talso the submissions advanced by Mr.Shah, ld.advocate for the<br \/>\n\tapplicant, the aforesaid condition is required to be suspended for a<br \/>\n\treasonable period, so that during that period, the applicant can get<br \/>\n\tback his passport from the trial Court and should complete his<br \/>\n\tformality regarding visa etc. and should go for the aforesaid<br \/>\n\treligious tour and can return back from the tour. Accordingly, the<br \/>\n\tpassport is required to be returned back by the trial Court for the<br \/>\n\tperiod of three months hereof. As soon as said period would be over,<br \/>\n\timmediately, the applicant shall re-deposit his passport before the<br \/>\n\ttrial Court.\n<\/p>\n<p>\tFor the foregoing<br \/>\n\treasons, the application is partly allowed. The condition laid down<br \/>\n\tin the order dated 17.04.2009 in Criminal Misc.Application No.1453<br \/>\n\tof 2009 regarding deposit of passport by the applicant, is suspended<br \/>\n\tfor the period of three months hereof, on the condition that within<br \/>\n\tthe said period of three months, the applicant shall complete his<br \/>\n\tformalities regarding visa etc.,  as well as during said period, he<br \/>\n\tshould complete his religious tour and as soon as said period of<br \/>\n\tthree months shall be over, the applicant shall immediately<br \/>\n\tre-deposit his passport before the trial Court. It is further<br \/>\n\tdirected that as soon as the applicant gets visa, and other<br \/>\n\tformalities to go for religious tour shall be over, the applicant<br \/>\n\tshall file his time schedule in writing in this matter.
